6 <br /> deterioration or damage, or for similar reasons, the code official shall require the <br /> defects to be corrected to eliminate the hazard. <br /> 8. IPMC 601.2 Responsibility, which reads: <br /> The owner of the structure shall provide and maintain mechanical and electrical <br /> facilities and equipment in compliance with these requirements. A person shall not <br /> occupy as owner-occupant or permit another person to occupy any premises which <br /> does not comply with the requirements of this chapter. <br /> 9. EMC 8.20.020, which reads: <br /> No person owning, leasing, renting, occupying or having charge or possession of <br /> any property in the city, including vacant lots, shall maintain or allow to be <br /> maintained on such property except as may be allowed by any other city ordinance <br /> any of the following conditions visible from any public street, alley or other public or <br /> private property: <br /> (A) Junk, trash, litter, boxes, discarded lumber or salvage materials or other similar <br /> materials in any front yard, side yard, rear yard or vacant lot. <br /> (C) Broken or discarded furniture, household equipment and furnishings in any front <br /> yard, side yard, rear yard or vacant lot; <br /> 10. EMC §1.20.010(E) Repeat Violator: <br /> "Repeat violator"means any person, firm, corporation, association, or agent thereof <br /> who has had any order issued pursuant to the provisions in this chapter, including <br /> any order issued subsequent to a hearing, any stipulated order and any default <br /> order, and within twenty-four months of the issuance of such order commits or <br /> allows to be committed a new and separate violation of a same or similar chapter of <br /> the Everett Municipal Code that is enforceable under this chapter, regardless of <br /> location. <br /> Conclusions of Law Based on Above Findings: <br /> 1. By allowing bagged garbage to be discarded near the garbage containers in the <br /> alley and broken furniture to be placed on the front porch of the residential structure <br /> on the property, the Respondent violated EMC 8.20.020(A)(C). These violations <br /> are public nuisances. <br /> 2. By allowing bagged trash to accumulate and remain near uncovered garbage <br /> containers on the property, the Respondent violated IPMC 308.3. <br /> 3. By not supplying a sufficient amount of approved garbage containers and not <br /> storing the accumulated garbage in approved containers, the Respondent violated <br /> IPMC 308.2 and IPMC 308.2.1. <br />
