Aviv <br /> ORDINANCE NO. 2646-02 <br /> AN ORDINANCE Relating to Criminal Mischief and Related Offenses, <br /> Amending Section 38 of Ordinance No. 1145-85 (EMC 10.66.010). <br /> WHEREAS, in 2002,the Legislature of the State of Washington clarified the definition <br /> of"property of another" as it relates to the crimes of Criminal Mischief and related <br /> offenses; and <br /> WHEREAS, the City of Everett City Council deems it appropriate for the City Criminal <br /> Code to be consistent with state law in this area; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 38 of Ordinance No. 1145-85 (EMC 10.66.010), which reads as <br /> follows: <br /> EMC 10.66.010 Definitions. <br /> Definitions. <br /> As used in this chapter: <br /> A. "Building" has the definition in Section 10.02.060 and where a building consists of <br /> two or more units separately secured or occupied, each unit shall not be treated as a <br /> separate building. <br /> B. "Damages," in addition to its ordinary meaning, includes any charring, scorching, <br /> burning, or breaking, or agricultural or industrial sabotage, and shall include any <br /> diminution in the value of any property as a consequence of an act. <br /> is hereby amended to read as follows: <br /> Definitions. <br /> As used in this chapter: <br />
