r <br /> r c <br /> ORDINANCE NO. 2647-02 <br /> AN ORDINANCE amending the City's sewer regulations <br /> concerning the authority for sewer districts to provide service to Everett <br /> residents, amending Ordinance No. 273-73 as amended (EMC 14.04) <br /> Whereas, the City Council finds that in limited instances sewer districts are in a position <br /> to provide Everett residents with sewer service; and <br /> Whereas, the City Council finds that the City currently has agreements with sewer <br /> districts such as Alderwood, Mukilteo, Olympus Terrace and Silver Lake sewer districts <br /> which authorize these districts to provide sewer service to Everett residents; and <br /> Whereas, the City Council finds that these agreements are limited in their scope and as <br /> such, there are instances not covered by the agreements wherein the districts are still in a <br /> better position than the City to provide sewer service to certain Everett residents; and <br /> Whereas, the City Council finds that the City should evaluate these instances on a case <br /> by case basis and make a determination as to whether residents in need of sewer service <br /> can indeed be better served by a sewer district and if so, then under what rates, terms and <br /> conditions; and <br /> Whereas, the City Council finds that there currently exist four Everett property owners <br /> which are in a location which is difficult for Everett to provide sewer service but who <br /> have an opportunity and desire to be served as a result of sewer lines being formed <br /> pursuant to an ULID by Olympus Terrace Sewer District; and <br /> Whereas, the City Council finds that there are appropriate situations for sewer districts to <br /> provide Everett residents with sewer service and as such, the City Council should have <br /> the authority and discretion to authorize such service on a case-by-case basis; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Ordinance No. 237-73, as amended (EMC 14.04) is hereby amended by the <br /> addition of the following section: <br /> Sewer District Service. <br /> Notwithstanding any language in Title 14 EMC, the City Council is authorized to allow <br /> the City to contract with sewer districts to provide Everett residents sewer service upon <br /> such rates, terms and conditions approved by the City which rates, terms and conditions <br />
