Labor; that it will furnish the City, HUD, and the Secretary of Labor such <br /> information as they may require for the supervision of such compliance; and that <br /> it will otherwise assist the City, HUD, and the Department of Labor in the <br /> discharge of the Department of Labor's primary responsibility for securing <br /> compliance. The Agency will also ensure the compliance of contractors and <br /> subcontractors with state requirements pertaining to equal opportunity. <br /> J. Non-Discrimination <br /> 1. County Human Rights Ordinance <br /> The Agency shall comply with Washington's Law against Discrimination, <br /> Chapter 49.60 RCW, and the Snohomish County Human Rights Ordinance, <br /> Chapter 2.460 SCC, which is incorporated herein by this reference. These <br /> laws protect against specific forms of discrimination in employment, credit <br /> transactions, public accommodation, housing, city and county facilities and <br /> services, and city and county contracts. <br /> Execution of this Loan Agreement constitutes a certification by the Agency of <br /> the Agency's compliance with the requirements of Chapter 2.460 SCC. If the <br /> Agency is found to have violated this provision, or to have furnished false or <br /> misleading information in an investigation or proceeding conducted pursuant <br /> to Chapter 2.460 SCC, this Loan Agreement may be subject to a declaration <br /> of default and termination at the City's discretion. This provision shall riot <br /> affect the Agency's obligations under other federal, state, or local laws <br /> against discrimination. <br /> 2. Federal Non-discrimination <br /> The City shall and shall cause the Agency to comply with HUD Final Rule, <br /> "Equal Access to Housing in HUD Programs Regardless of Sexual <br /> Orientation or Gender Identity," 70 Fed. Reg. 5,662 (Feb. 3, 2012) (to be <br /> codified at 24 C.F.R. Parts 5, 200, 203, 236, 291, 570, 574 and 982). <br /> K. Environmental Review <br /> 1. NEPA <br /> Pursuant to 24 CFR § 92.352(b)(1), the County retains responsibility for <br /> environmental review, decision making and action for purposes of fulfilling <br /> requirements of the National Environmental Policy Act ("NEPA") for each <br /> activity carried out with HOME funds.
