amended (33 U.S.C. § 1318), relating to inspection, monitoring, entry, <br /> reports, and information, as well as all other requirements specified in <br /> said Section 114, Section 308, and all regulations and guidelines <br /> issued thereunder; <br /> 3) A stipulation that, as a condition for the award of the contract, prompt <br /> notice will be given of any notification received from the Director, Office <br /> of Federal Activities, EPA, indicating that a facility utilized or to be <br /> utilized for the contract is under consideration to be listed on the EPA <br /> List of Violating Facilities; and <br /> 4) Agreement by the contractor that it will include or cause to be included <br /> the criteria and requirements referred to in this section in every non- <br /> exempt subcontract, and that it will take all appropriate actions to <br /> enforce these requirements. <br /> b. In no event shall any amount of the assistance provided under this Loan <br /> Agreement be utilized with respect to a facility which has given rise to a <br /> conviction under Section 113(c)(I) of the Clean Air Act or Section 309(c) of <br /> the Federal Water Pollution Control Act. <br /> L. Displacement, Relocation, and Acquisition <br /> Any displacement of persons, businesses, or non-profit organizations occurring <br /> as the result of demolition, conversion in use, rehabilitation or acquisition of real <br /> property for an activity assisted by this Loan Agreement shall comply with the <br /> Uniform Relocation Assistance and Real Property Acquisition Policies Act of <br /> 1970, as amended (42 U.S.C. § 4201 et seq.), its implementing regulations at 49 <br /> CFR Part 24, and Section 104(d) of the Housing and Community Development <br /> Act. In the event any occupant is deemed by the City, the County or by a higher <br /> authority to have been displaced due to assistance provided under this <br /> Agreement and thereby to be entitled to relocation assistance under these <br /> authorities, the Agency shall be solely responsible for providing the required <br /> assistance and paying all costs thereof, and the Agency shall hold the City and <br /> the County harmless from any liability for such assistance. If there is <br /> displacement or relocation, the Agency shall follow a relocation plan for current <br /> residents of the Premises that has been pre-approved by the County prior to any <br /> displacement or relocation of residents. <br /> M. Lead-Based Paint <br /> The Project shall be conducted and administered in compliance with the Lead- <br /> Based Paint Poisoning Prevention Act (42 U.S.C. §§ 4821-4846), the Residential <br /> Lead-Based Paint Hazard Reduction Act of 1992 (42 U.S.C. §§ 4851-4856), and <br /> implementing regulations at 24 CFR Part 35, subparts A, B, J, K, M, and R, and <br /> Amended HOME Loan Agreement <br /> Housing Hope's Kennedy Court Improvement Project <br /> Page 12 of 53 <br />
