G. Taxes, Assessments, and Encumbrances <br /> Property taxes and utilities on the Premises shall be brought current through the <br /> date of the final execution of this HOME Agreement. In the event the Agency <br /> does not bring such taxes and utilities current prior to that date, the Agency <br /> agrees to pay such taxes and utilities within ten (10) days of the date of the final <br /> execution of this HOME Agreement and to provide to the City an addendum to <br /> the title policy establishing such payment. <br /> The Agency agrees to pay before delinquency all taxes, assessments, and any <br /> other charges affecting the Premises when due, and all encumbrances, charges, <br /> and liens, with interest, on the Premises or any part, subject to the Agency's right <br /> to contest such taxes, assessments and other charges in good faith. <br /> H. Eligibility for Admission <br /> An applicant is eligible for admission to the Project if he or she meets all of the <br /> following criteria: <br /> 1. For HOME-Assisted Units: The applicant meets the income and other <br /> requirements of the HOME Program as set forth in the HOME Regulations <br /> and this Loan Agreement and meets the income eligibility requirements of any <br /> other funding sources providing funds for the Project, which sources and <br /> eligibility requirements have been approved by the City. <br /> 2. The Agency may determine that an applicant is not eligible for admission if, <br /> on the basis of substantial, factual evidence of that person's prior actions, <br /> there is good cause to believe that the applicant will repeatedly fail to pay <br /> rent, will create a substantial threat to the health and safety of other residents, <br /> or will repeatedly breach material requirements of the lease. Unsubstantiated <br /> oral statements will not be deemed substantial factual evidence. <br /> I. Resident Selection Procedures; Management Plan <br /> The Agency shall rent housing units in the Project to eligible residents, in <br /> accordance with the HOME Regulations and a Management Plan approved by <br /> and on file with the City. The Management Plan shall include at least the <br /> following: <br /> 1. Detailed actions to be taken by the Agency to affirmatively market and rent all <br /> units in accordance with HOME Program requirements at 24 CFR § 92.351 in <br /> a manner which ensures equal access to all persons in any category <br /> protected by federal, state, or local laws governing discrimination, and without <br /> regard to any arbitrary factor; <br /> Amended HOME Loan Agreement <br /> Housing Hope's Kennedy Court Improvement Project <br /> Page 25 of 53 <br />
