H. Notices <br /> Written notices and other written communications by and between the parties <br /> hereto shall be in writing, shall be personally delivered, emailed, or sent by <br /> certified mail, return receipt requested, postage prepaid, and shall be deemed <br /> given when so delivered or received. Gender <br /> The use of the plural in this Loan Agreement shall include the singular and the <br /> singular shall include the plural; and the use of one gender shall be deemed to <br /> include either gender. <br /> J. Captions <br /> The captions used in this Loan Agreement are inserted only as a matter of <br /> convenience and for reference and in no way define, limit, or describe the scope <br /> of the intent of this Loan Agreement. <br /> K. Time of the Essence <br /> Time is of the essence in the performance of each party's obligations under this <br /> Agreement. Each party will carry out its obligations under this Loan Agreement <br /> diligently and in good faith. <br /> L.
