CITY <br /> LICENSE TO USE CITY PROPERTY <br /> THIS LICENSE AGREEMENT (the "Lica n se"), bbetw the City of Everett as <br /> Grantor(the"City) and Reece Construction,Po Box 1531, Marysville, WA 98270 as <br /> the Grantee ("Reece"), relates to property owned by the City located at 1700 State Street, <br /> Everett, WA(the"Property"). <br /> RECITALS <br /> A. Reece desires to utilize property owned by the City for staging and <br /> construction materials while performing work for the City's Tulalip Water Transmission <br /> Pipeline Project("Project") <br /> B. The City is willing to grant Reece authority to use the City's property <br /> upon certain terms and conditions. <br /> AGREEMENT <br /> In consideration of mutual benefits and other good and valuable consideration,the receipt <br /> and sufficiency of which is hereby expressly acknowledged, the City licenses Reece to <br /> use the Property upon the following terms and conditions: <br /> Section 1. LICENSED PROPERTY. The specific area of property owned by the <br /> City, and subject to this License, is the area as depicted in Exhibit A, attached hereto, or <br /> as otherwise directed by the City's on-site supervisor. <br /> Section 2. TERM. This License shall be effective beginning July 27, 2016, and shall <br /> expire on December 30, 2016, unless terminated earlier upon 30-days' notice per Section <br /> 7,below. <br /> Section 3. Intentionally Omitted. <br /> Section 4. AUTHORIZED USE. Reece may only use the Property for the purpose <br /> of storing, loading, and unloading materials in conjunction with the Project being <br /> performed for the City. Incident to this authorized use,Reece may install temporary <br /> fencing in conformance with Section 16,below. <br /> Section 5. INDEMNIFICATION. Reece hereby agrees to defend, indemnify and <br /> hold the City harmless from any and all Claims for injury to people or damage to <br /> property arising out of or related to this License.
