CITY LICENSE TO USE CITY PROPERTY THIS LICENSE AGREEMENT (the "Lica n se"), bbetw the City of Everett as Grantor(the"City) and Reece Construction,Po Box 1531, Marysville, WA 98270 as the Grantee ("Reece"), relates to property owned by the City located at 1700 State Street, Everett, WA(the"Property"). RECITALS A. Reece desires to utilize property owned by the City for staging and construction materials while performing work for the City's Tulalip Water Transmission Pipeline Project("Project") B. The City is willing to grant Reece authority to use the City's property upon certain terms and conditions. AGREEMENT In consideration of mutual benefits and other good and valuable consideration,the receipt and sufficiency of which is hereby expressly acknowledged, the City licenses Reece to use the Property upon the following terms and conditions: Section 1. LICENSED PROPERTY. The specific area of property owned by the City, and subject to this License, is the area as depicted in Exhibit A, attached hereto, or as otherwise directed by the City's on-site supervisor. Section 2. TERM. This License shall be effective beginning July 27, 2016, and shall expire on December 30, 2016, unless terminated earlier upon 30-days' notice per Section 7,below. Section 3. Intentionally Omitted. Section 4. AUTHORIZED USE. Reece may only use the Property for the purpose of storing, loading, and unloading materials in conjunction with the Project being performed for the City. Incident to this authorized use,Reece may install temporary fencing in conformance with Section 16,below. Section 5. INDEMNIFICATION. Reece hereby agrees to defend, indemnify and hold the City harmless from any and all Claims for injury to people or damage to property arising out of or related to this License.
