RELEASE IN FULL OF ALL CLAIMS
<br /> IN CONSIDERATION of the sum of One Hundred Ten Thousand and 00/100
<br /> Dollars($110,000.00),the undersigned, Stephen Dittoe and Charlene Dittoe
<br /> (Releasors), on behalf of themselves individually and on behalf of their marital
<br /> community, hereby release, acquit.and forever discharge:the City of Everett, its officers,
<br /> directors,employees, volunteers, agents, insurers, attorneys, and representatives
<br /> ("Releasees") of and from any and all claims, demands, debts, liabilities, damages, and
<br /> causes of action of whatever kind or nature known and unknown, foreseen and
<br /> unforeseen, and the consequences thereof, whether based on tort, contract or statute,
<br /> existing or arising in the future, in any way connected with or arising out of incidents on
<br /> or about the 29th day of August, 2013, and the 6th day of:September, 2Q13, at or near
<br /> 1411 Rucker Avenue, Everett, WA, including without limitation all claims for property
<br /> damage at such address and personal injury claims of Charlene Dittoe and all claims in
<br /> Tort Claim Nos. D092-13 and D150-13 filed with the City of Everett.
<br /> Releasors acknowledge and agree that advances in the total amount of
<br /> $28,283.54 toward settlement reduce the final settlement payment to$81,716.46 and
<br /> direct that the City of Everett pay the final settlement amount as follows: $81,716.46
<br /> payable to"Cogdill Nichols Rein Wartelle Andrews in Trust for Charlene and Steve
<br /> Dittoes
<br /> FURTHER, the Releasors represent and agree that:
<br /> 1. The execution of this Release prohibit you, your heirs, children, relatives,
<br /> assigns, beneficiaries and representatives from asserting any claim.at any time against
<br /> any of the Releasees for injuries or damages in any way connected with or arising out of
<br /> the above-referenced matter. Releasors further understand and agree that this Release
<br /> is made solely for the settlement payment specified herein, and without reliance on any
<br /> statement or representation of the Releasees, their representatives, attorneys or.
<br /> agents. It is further understood and agreed that this Release is a compromise and
<br /> settlement of disputed claims and in no way constitutes an admission by the Releasees,
<br /> or any of them, of any fault or liability whatever in connection with any matter or thing.
<br /> 2. Releasors have the exclusive right and sole authority to settle this matter,
<br /> to execute this Release, and to receive or share in the settlement payment.
<br /> 3. A. Releasors agree to satisfy and discharge all liens for hospital, la-'7
<br /> medical, chiropractic, Medicare, Medicaid, social services or other health care provider`3
