J <br /> Section 9. Section 5 of Ordinance No. 534-78, as amended by Section 2 of Ordinance <br /> No. 690-80, as amended by Section 1 of Ordinance No. 1971-93, as amended by <br /> Section 11 of Ordinance 2394-99 (EMC 20.08.090), which reads as follows: <br /> Public nuisance and disturbance noises. <br /> A. Public Nuisance Noises. Pursuant to Section 20.08.200 of this chapter, the <br /> administrator may determine that a sound constitutes a public nuisance noise as <br /> defined herein. It is unlawful for any person to cause or allow to be emitted a <br /> noise which has been determined a public nuisance noise. <br /> B. Public Disturbance Noises. It is unlawful for any person to cause, or for any <br /> person in possession of property to allow to originate from the property, sound <br /> that is a public disturbance. No sound source specifically exempted from a <br /> maximum permissible sound level by this chapter shall be a public nuisance <br /> noise or public disturbance noise insofar as the particular source is exempted. <br /> The following sources of sound shall be public disturbance noises and are also <br /> subject to regulation under the provisions of Sections 20.08.030 through <br /> 20.08.050: <br /> 1. The frequent, repetitive or continuous sounding of any horn or siren <br /> attached to a motor vehicle, except as a warning of danger or as <br /> specifically permitted or required by law; <br /> 2. The creation of frequent, repetitive or continuous noise in connection with <br /> the starting, operation, repair, rebuilding or testing of any motor vehicle, <br /> motorcycle, off-highway vehicle or internal combustion engine within <br /> District I so as to unreasonably disturb or interfere with the peace, comfort <br /> and repose of owners or possessors of real property; <br /> 3. Yelling, shouting, hooting, whistling or singing on or near the public <br /> streets, particularly between the hours of eleven p.m. and seven a.m. or at <br /> any time and place so as to unreasonably disturb or interfere with the <br /> peace, comfort and repose of owners or possessors of real property; <br /> 4. The use of a sound amplifier or other device capable of producing or <br /> reproducing amplified sound upon public streets for the purpose of <br /> commercial advertising or sales or for attracting the attention of the public <br /> to any vehicle, structure or property or the contents therein, except as <br /> permitted by law, and except that vendors whose sole method of selling is <br /> from a moving vehicle shall be exempt from this subsection; <br /> 5. The creation of frequent, repetitive or continuous sounds which emanate <br /> from any building, structure, apartment or condominium, which <br /> unreasonably interferes with the peace, comfort and repose of owners or <br /> 72 <br />
