7. Implementation of the Shoreline Public Access Plan would provide public access to
<br /> shorelines of the state, provide recreational resources for Everett's increasing population,
<br /> connect Everett's neighborhoods, improve the city's non-motorized transportation
<br /> network, catalyze new physical and economic development, incorporate environmental
<br /> restoration, activate existing and future parks, and link the city to regional trails and
<br /> Everett's rural surroundings; and.
<br /> 8. The Shoreline Public Access Plan set forth in Exhibit A is consistent with and
<br /> implements the City of Everett Comprehensive Plan, including, but not limited to, the
<br /> Public Access Element of the Shoreline Master Program; Economic Development
<br /> Objectives 5.1.3, 5.4.2, 5.5, 5.5.1, 5.5.5, 5.5.6 and Policies 5.1.12, 5.2.6, 5.4.1. 5.4.2,
<br /> 5.4.3, 5.4.4, 5.4.5; Land Use Policies 1.1.5, 1.11.9.a.5, 1.11.10; Transportation Element
<br /> Objective 6 and its policies; Urban Design Objectives 6.4.3, 6.5.7, 6.7.1, 6.7.2, 6.7.3,
<br /> 6.7.7 and Policies 6.5.4, 6.5.5, 6.7.1, 6.7.2, 6.7.3, 6.7.4, 6.7.8; and Parks and Recreation
<br /> Element Goal 1.1.0 and Objectives 1.2, 1.3; and
<br /> 9. Public access to Everett's shorelines is essential to the public health of the citizens of
<br /> Everett and the State, as well as to the vitality of the City; and
<br /> 10. The provision of public access to the shorelines is a high priority of the City;
<br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN:
<br /> SECTION l: That the City Council hereby adopts the Shoreline Public Access Plan as set forth
<br /> in Exhibit A, which is attached hereto and incorporated herein by reference.
<br /> SECTION 2: That the City Council hereby amends Ordinance No. 2021-94, as amended, to add
<br /> the following section:
<br /> That the City Council incorporates the Shoreline Public Access Plan adopted in Ordinance No.
<br /> , as a functional plan/sub-element of the Everett Comprehensive Plan.
<br /> SECTION 3: That where there is a conflict between this Shoreline Public Access Plan and any
<br /> previously adopted related plan, such as the Non-Motorized Transportation Plan and the
<br /> Harborfront Public Access Plan, the Shoreline Public Access Plan shall take precedence.
<br /> SECTION 4: Severability. That should any section, subsection, paragraph, sentence, clause or
<br /> phrase set forth in this ordinance or in Exhibit A or its application to any person or situation be
<br /> declared unconstitutional or invalid for any reason, such decision shall not affect the validity of
<br /> the remaining portions of this ordinance or Exhibit A or its application to any other person or
<br /> situation. The City Council of the City of Everett hereby declares that it would have adopted this
<br /> ordinance and Exhibit A and each section, subsection, sentence, clause, phrase, or portion thereof
<br /> irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or
<br /> portions be declared invalid or unconstitutional.
