1 <br /> jelP/441, 10•4 <br /> ORDINANCE NO. 2699-03 <br /> AN ORDINANCE EXTENDING COMCAST OF EVERETT, INC.'S CABLE TELEVISION <br /> FRANCHISE PURSUANT TO SECTION 13.1(B) OF ORDINANCE 2613-02 <br /> WHEREAS, the City granted Everett Cablevision, Inc., a Washington corporation also <br /> known as AT&T Broadband, a franchise to provide cable television services in the City in <br /> ordinance no. 2613-02; and <br /> WHEREAS, the City consented to internal restructuring and a change of control from <br /> AT&T to Comcast Corporation in ordinance 2610-02; and <br /> WHEREAS, following the change of control consent process, the legal name of the cable <br /> system operator changed from Everett Cablevision, Inc. to Comcast of Everett, Inc. ("Comcast"); <br /> and <br /> WHEREAS, the cable television franchise became effective on July 11, 2002 and <br /> terminates on July 12, 2012,pursuant to section 2.3 of ordinance no. 2613-02; and <br /> WHEREAS, section 13.1(A) of ordinance 2613-02 required the cable system operator to <br /> upgrade the cable plant: <br /> Grantee shall upgrade and activate the Cable System bandwidth to a minimum of 750 MHz <br /> and provide two-way capability throughout the Franchise Area, no later than thirty-six (36) <br /> months from the Effective Date of this Franchise. The Grantee intends to deploy fiber <br /> optics to nodes that serve no more than twelve hundred (1,200) homes passed as part of the <br /> upgrade. Grantee may provide for phased activation launches of applicable portions of the <br /> Cable System as nodes are completed. Grantee may substitute another transmission <br /> material and/or modify its upgrade design provided that the same technical benefits in <br /> reliability and picture quality are attained. The Cable System shall be capable of supporting <br /> video, audio and Cable Internet Service (to the extent the latter is considered a Cable <br /> Service pursuant to applicable law). Upon completion of the upgrade, the Cable System <br /> shall be capable of delivering two hundred (200) Channels of video programming services <br /> to Subscribers, provided that the Grantee reserves the right to use the bandwidth in the <br /> future for other uses based on market factors. <br /> and; <br /> An Ordinance Extending Comcast of Everett, Inc.
