Section 2. Definition. Section 4.020.A of Ordinance No. 1671-89, as amended, (EMC <br /> 19.04.020), is amended by the addition of the following definition: <br /> "Opiate substitution treatment facility" means an organization that administers or <br /> dispenses an approved drug as specified in 212 CFR Part 291 for treatment of detoxification <br /> of opiate substitution. The agency is: <br /> (1) Approved by the Federal Food and Drug Administration; <br /> (2) Registered with the Federal Drug Enforcement Administration; <br /> (3) Registered with the State Board of Pharmacy; <br /> (4) Licensed by the county in which it operates; and <br /> (5) Certified as an opiate substitution treatment agency by the State Department of <br /> Social and Health Services. <br /> Section 3. Definition. Section 4.020.A of Ordinance No. 1671-89, as amended, (EMC <br /> 19.04.020.A), definition of "clinic," which reads as follows: <br /> "Clinic" means a building or portion of a building containing an office or offices of <br /> medical doctors, dentists, psychiatrists, chiropractors,physical therapists and other <br /> members of the medical profession which provide facilities and services for outpatient <br /> care, diagnosis, treatment and observation of individuals suffering from illness, injury or <br /> other conditions requiring medical, surgical or therapeutic services. A clinic does not <br /> include facilities providing patient beds for overnight care. See also "medical-related <br /> activities." <br /> is hereby amended to read as follows: <br /> "Clinic" means a building or portion of a building containing an office or offices of <br /> medical doctors, dentists, psychiatrists, chiropractors, physical therapists and other <br /> members of the medical profession which provide facilities and services for outpatient <br /> care, diagnosis, treatment and observation of individuals suffering from illness, injury or <br /> other conditions requiring medical, surgical or therapeutic services. This definition does <br /> not include facilities providing patient beds for overnight care, or opiate substitution <br /> treatment facilities. See also "medical-related activities." <br /> Section 4. Permitted Use. Ordinance No. 1671-89, as amended, (Title 19 EMC) is <br /> amended by the addition of"opiate substitution treatment facility" as a permitted use, <br /> Review Process I, to the Use Tables of EMC Title 19 in the category of"Medical Uses," in <br /> the C-1 zone areas located south of SR 526, and in the two existing hospital facilities <br /> currently located in Everett or hospital facilities, as defined in EMC Title 19, that may be <br /> established in the future. Only one opiate substitution treatment facility may be established <br /> in the City under this provision as a permitted use using Review Process I. In order for any <br /> subsequent opiate substitution treatment facility to be established in the City, the City must <br /> first adopt an essential public facilities siting ordinance implementing the Interlocal <br /> Agreement to Implement Common Siting Process for Essential Public Facilities, include <br /> opiate substitution treatment facilities as essential public facilities under said ordinance, and <br /> must comply with said ordinance as well as all other applicable regulations. <br />
