6.2 Communication. Both the City and County agree to work in good <br /> faith to implement the Shared Work and the Breach and Related Work, <br /> and to adapt to work conditions as appropriate within the framework <br /> of this Agreement. <br /> 6.2.1 Design communication and coordination <br /> • The County will actively involve the City in <br /> communications on the Smith Island Project design. <br /> • The City will note any objections in a timely manner, and <br /> work with the County on reconciling issues. <br /> 6.3. Correction for Defective Work <br /> 6.3.1 The County, as lead entity, shall be responsible for undertaking <br /> any repair or correction necessary as a result of any defect in <br /> design, workmanship or materials in the performance of the <br /> Shared Work; Provided,however, any additional cost incurred <br /> by the County to the extent that the costs are not recoverable by <br /> the parties in correcting such work shall be shared by the <br /> parties as a General Shared Cost in accordance with Exhibit B, <br /> subject to the City Maximum Shared Cost Obligation. <br /> 6.3.2 The City and County, or their respective contractors, shall each <br /> be separately responsible for repair or correction to any defect <br /> in design, workmanship or materials relating to the respective <br /> portions of the setback dikes in the Smith Island-County and <br /> Smith Island-City area, and associated work within the Smith <br /> Island Project site as required for those setback dikes. <br /> 6.4 Costs Unanticipated by this Agreement <br /> 6.4.1 The County and City shall quarterly review the Smith Island <br /> Project costs to the extent of costs incurred by each party not <br /> contemplated by this Agreement but related to an aspect of the <br /> work in the Agreement. The parties may meet more frequently <br /> as needed. <br /> Section 7. Access to Property <br /> To ensure the County and City are able to promptly and efficiently perform the <br /> services and execute the responsibilities in this Agreement, the parties mutually agree <br /> to the following: <br /> 7.1 City Access to County Property. <br /> The County agrees to provide the City with reasonable access to all properties <br /> and regions under their ownership in the Smith Island Project, including any <br /> adjacent or adjoining properties over which access is reasonably necessary, <br /> until such time as the City's services have been completed and responsibilities <br /> INTERLOCAL AGREEMENT FOR <br /> IMPLEMENTATION OF THE SMITH ISLAND RESTORATION PROJECT PAGE 11 <br />
