3.2 SEPA Review—The City will cooperate with the County in supporting the <br /> SEPA process for the Smith Island Project referenced in Section 2.2, including <br /> City staff assistance in all work contributing to preparation of the Final EIS and <br /> work involved in responses to any challenges, excluding actual legal costs. <br /> 3.3 Design of Smith Island Project—The City is responsible for the design of <br /> Breach and Related Work in the Smith Island-City area. This design is in <br /> accordance with Section 4 below. The City is not responsible for design of any <br /> Shared Work and the City is not responsible for design of Breach and Related <br /> Work in the Smith Island-County area. <br /> 3.4 Permitting of Smith Island Project—The City will obtain all necessary permits <br /> for work to be completed in the Smith Island-City area. Since it is intended that <br /> the County will perform construction of Breach and Related work in the Smith <br /> Island-City area, County contractor compliance with such permits will be <br /> addressed by amendment to this agreement or separate agreement per Section <br /> 2.10. The County will assist the City in obtaining such permits for County <br /> contractor work as applicable in the Smith Island-City area. <br /> 3.5 Construction of Smith Island Project— <br /> 3.5.1 Shared Work. The City will cooperate with the County in the County's <br /> construction of the Shared Work. In connection with the Dike <br /> Connection, the City will provide the County with the City's available <br /> compaction results. <br /> 3.5.2 Breach and Related Work. The City will cooperate with the County in <br /> the County's construction of the Breach and Related Work. The City <br /> will comply with Exhibit C with respect to the County's construction of <br /> Breach and Related Work in the Smith Island-County area. <br /> 3.6 Public Outreach—The City will support the County on public outreach efforts, <br /> including but not limited to the following by way of illustration: <br /> • Attend County meetings to promote the Smith Island Project <br /> • Represent the City in such meetings as partner on the Smith Island <br /> Project <br /> 3.7 Access—Should easements be needed for access to City property, and such <br /> access is not possible via City or County property, the City will obtain all such <br /> easements and associated agreements. <br /> 3.8 Prior Completion of City Setback Dike, Breach and Starter Channels—The <br /> parties acknowledges that the City is completing certain work on City property <br /> in Smith Island, relating to the City setback dike and drainage. This work is not <br /> part of the Smith Island Project,but is closely related to it. The City will be <br /> completely responsible for the design,permitting and construction and <br /> associated costs of all such work on City property, including but not limited to <br /> the following: funding, SEPA review, design, design coordination with the <br /> INTERLOCAL AGREEMENT FOR <br /> IMPLEMENTATION OF THE SMITH ISLAND RESTORATION PROJECT PAGE 9 <br />
