I, "System" means all facilities for solid waste handling owned or operated, or contracted for, by the county, and all administrative activities related thereto. Section 3: Snohomish County system designated. All solid waste generated within the corporate limits of the City shall be disposed of through the County system as provided for in the comprehensive plan, which is hereby adopted by this reference, except as otherwise provided in Section 6. Section 4: Snohomish County authority. Snohomish County is authorized to designate disposal sites for the disposal of all solid waste which is generated within the City, subject to all applicable laws and regulations of the Snohomish Health District and the City. Section 5: Solid waste diversion, County approval required. No solid waste may be diverted from the disposal sites designated by the County without the County's approval or as provided in the comprehensive plan. Section 6: When disposal provisions shall not apply. Sections 3 through 5 of this Ordinance shall not apply: A. To the disposal of solid waste through the waste recycling element of the comprehensive plan or any waste reduction or recycling plan approved by the County; B. To disposal of hazardous wastes or substances where disposal into the County system is prohibited or where other provisions pursuant to state or federal law are made for the handling of such wastes or substances; C. Where disposal is otherwise provided for under state or federal law. Section 7: Unlawful disposal of solid waste. It is unlawful for any person to dispose of any solid waste generated in the City and subject to this ordinance unless that person complies with the provisions of RCW 70.95.240, 70.95.500 and 70.95.610 which are hereby adopted by this reference. Section 8: Penalties. Any violation of the provisions of RCW 70.95.240 shall be a misdemeanor, and any person found guilty thereof shall be punished by a fine not to exceed $1,000 or imprisonment in jail not to exceed 90 days, or by both such fine and imprisonment. Any violation of the provisions of RCW 70.95.610 shall be a misdemeanor, punishable by a fine not to exceed $1,000. Any violation of the provisions of RCW 70.95.500 shall be no less than $200.00 nor more than $2,000 for each offense. Section 9: Severability. If any section, subsection, sentence, clause, phrase or word of this chapter should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality thereof shall not affect the validity or constitutionality of any other section, subsection, sentence, clause, phrase or word of this ordinance. Section 11:Corrections. The City Clerk and the codifiers of this ordinance are authorized to make necessary corrections to this ordinance including, but not limited to, the correction of scrivener's/clerical errors, references, ordinance numbering, section/subsection numbers and any references thereto. 2
