CITY <br /> LEASE RENEWAL <br /> and AMENDMENT No.2 <br /> This Lease Renewal and Amendment No. 2 is dated as of this day of 2016, by <br /> and among City of Everett, a Washington State municipal corporation ("Lan lord"or <br /> "Lessor"), and Snohomish County Police and Auxiliary Services Center,and interlocal <br /> association of municipalities also known as SNOPAC,("Tenant"or"Lessee"). <br /> RECITALS <br /> The Landlord,by that certain Lease Agreement dated the 18th day of June, 2001, as <br /> amended by that certain Amendment No. 1 dated October 5, 2009 (the "Lease") <br /> leased to Tenant, certain real property located in Everett, Washington which premises <br /> is 1121 SE Everett Mall Way, Everett, Washington(the "Building"); and Landlord <br /> and the Tenant,hereby express their mutual desire to exercise the first option to <br /> renew the lease as provided for in Section 2 of the lease and wish to modify the <br /> renewal period to extend the Lease as provided for herein. That portion of Section 2 <br /> which reads: <br /> ..... this Lease may be renewed up to five (5) years at one year(1) year <br /> increments..... <br /> Is hereby replaced with: <br /> .....this Lease may be renewed up to six (6) years at two (2)year increments... <br /> The Lease is hereby extended commencing on July 1,2016 and will expire on June <br /> 30,2018. <br /> The Landlord and Tenant,also hereby express their mutual desire to adjust the rent to <br /> reflect market rent. <br /> Commencing July 1,2016, the monthly rent under this term of the Lease is <br /> hereby adjusted to start at $20,393.75. ($1.25 per square foot per month) for the <br /> entire Premises,an annual rent of$244,725.00. All other provisions of Section 4 <br /> remain unchanged. <br /> Full Force and Effect. The parties agree that the Lease remains in full force and <br /> effect without interruption, except as expressly modified by this Amendment, and as <br /> of the date of this Amendment, the parties know of no facts or circumstances that <br /> would constitute a default under the Lease. <br /> This LEASE RENEWAL and AMENDMENT No. 2 is hereby approved and accepted by: <br /> 1 of 3 <br />
