WHEREAS, Staff and the Planning Commission have incorporated many additional <br /> changes into the proposed amendments as a result of public testimony; and <br /> WHEREAS, The proposed amendments to the Land Division Ordinance ensure that lots <br /> created through the subdivision process protect the public health, safety and welfare by <br /> requiring sufficient yard area to provide adequate separation between buildings,promote <br /> privacy between dwellings, and protect property values; and <br /> WHEREAS, The proposed amendments to the Land Division Ordinance are consistent <br /> with the applicable provisions of the Everett Comprehensive Plan; bear a substantial <br /> relation to the public health, safety and welfare; and promote the best long term interests <br /> of the Everett community; and <br /> WHEREAS, The proposed amendments to EMC Title 18 and EMC Title 19 require <br /> corresponding amendments to the Local Project Review Procedures Ordinance (EMC <br /> Title 15). <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 1.F.3 of Ordinance No. 2328-98, as amended by Ordinance No. 2536- <br /> 01 (EMC 18.04.080(3)), which reads in part as follows: <br /> 3. Alteration"means any alteration of a recorded subdivision or short subdivision or <br /> portion thereof, except as provided in RCW 58.17.040(6) and Title 15 of this code, Local <br /> Project Review Procedures, that would alter,redesign or eliminate a public street, <br /> easement access road, common ownership area(s), greenbelt(s), environmentally <br /> sensitive area(s), open space tract(s), and restrictive covenant(s) required by the city to be <br /> shown on the face of the final plat or short plat map. <br /> is hereby amended to read as follows: <br /> 3. "Alteration"means any alteration of a recorded subdivision or short subdivision or <br /> portion thereof, except as provided in RCW 58.17.040(6) and Title 15 of this code, Local <br /> Project Review Procedures, that would alter, redesign or eliminate a public street, <br /> easement access drive, common ownership area(s), greenbelt(s), environmentally <br /> sensitive area(s), open space tract(s), and restrictive covenant(s)required by the city to be <br /> shown on the face of the final plat or short plat map. <br /> Section 2: Section 1.F.33 of Ordinance No. 2328-98, as amended by Ordinance No. <br /> 2536-01 (EMC 18.04.080(33)), which reads in part as follows: <br /> 33. "Easement access"means a drive-in private ownership utilized principally for <br /> providing access to lots, tracts,parcels or sites from an improved public right-of-way. <br /> is hereby amended to read as follows: <br />
