ORDINANCE NO. 3392-14 <br /> AN ORDINANCE Establishing the Zoning as B-2(B) (Office) <br /> for the Holdeman Annexation Area Located East <br /> of 19th Avenue between 106th Place South East and 108th Street <br /> South East and Amending the City's Zoning Map Accordingly <br /> WHEREAS, the City of Everett is provided authority to annex contiguous unincorporated <br /> territory under RCW 35.13.125; and <br /> WHEREAS,the City completed the requisite steps to annex the Holdeman annexation area <br /> (Exhibit"A") as follows: City Council authorized gathering of signatures on the 60 percent <br /> petition on July 31, 2013; the completed 60 percent petition was submitted to the Snohomish <br /> County Auditor, who then certified it on October 18, 2013; City Council accepted the <br /> completed and certified 60 percent petition on December 18, 2013; under Council Resolution <br /> 6686, the City submitted a Notice of Intent to Annex to the Snohomish County Boundary <br /> Review Board on January 28, 2014; the Boundary Review Board granted final approval to <br /> proceed on April 1, 2014, after their 45 day review period passed without jurisdiction being <br /> invoked; and <br /> WHEREAS, the City Council finds that on May 6, 2014, the Planning Commission held a <br /> public hearing regarding establishment of the enabling zone for the subject area upon <br /> annexation to the City; and <br /> WHEREAS, after the public hearing on May 6, 2014,the Planning Commission made the <br /> recommendation that the Holdeman annexation area be zoned B-2(B) (Office); and <br /> WHEREAS,THE CITY COUNCIL FINDS: <br /> 1. Planning Commission did hold a public hearing on May 6, 2014, at which time the <br /> Commission afforded the public an opportunity to speak and heard from staff <br /> regarding the establishment of a use zone for the annexation as provided herein. <br /> 2. At the noted public hearing, Planning Commission concurred with the 4.3 (Office) <br /> Comprehensive Plan map designation for the area and recommended the use of the B- <br /> 2(B) (Office) zone (Exhibit A), as called for in the Comprehensive Plan's Land Use <br /> Element(page 76), in the Equivalent Zoning Table. <br /> 3. The Legal Description of the annexation area perimeter is as follows and is hereafter <br /> referred to as the "Property": <br /> 1 <br />
