00,'"41 <br /> Itigii <br /> ORDINANCE NO. 2723-03 <br /> An Ordinance Concerning Restricting Locations for <br /> Vendors, Solicitors, Hawkers, Canvassers, Peddlers and <br /> Mobile Food Units, amending Chapter 21of Ordinance <br /> No. 295-74 (EMC 5.84.090) and Chapter 9 of Ordinance <br /> No. 295-74 (EMC 5.36.070) <br /> WHEREAS, based upon the experience of other communities, vending activities within <br /> the public rights-of-way within the immediate vicinity of events and stadium areas, can <br /> have a significant impact on pedestrian safety and vehicular traffic; and <br /> WHEREAS, it is anticipated that unregulated vending activities within the public rights- <br /> of-way within the immediate vicinity of the Everett Events Center scheduled for opening <br /> October 2003 would have similar impacts on pedestrian safety and vehicular traffic; and <br /> WHEREAS, those rights-of-way immediately adjacent to the Everett Events Center <br /> require special treatment in regards to vendor activity; and <br /> WHEREAS, the Everett Public Facilities District supports the imposition of special <br /> regulations concerning the restriction of vending activity within the immediate vicinity of <br /> the Everett Events Center to provide for a better flow of pedestrian and vehicular traffic <br /> in conjunction with events held at the Everett Events Center; and <br /> WHEREAS, it is necessary to revise the City's regulations concerning vendors, <br /> hawkers, solicitors, canvassers and peddlers to provide necessary locational <br /> restrictions concerning these activities; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. No Vending Activity. <br /> Notwithstanding any other City regulation, it is unlawful to sell, offer to sell, solicit, order, <br /> rent, lease or otherwise peddle or distribute any goods, including any food or beverage <br /> or services of any kind on public rights-of-way within the area bounded by the North <br /> right-of-way line of California Street, the South right-of-way line of Pacific Avenue, the <br /> West right-of-way line of Rockefeller Avenue and the East right-of-way line of McDougal <br /> Avenue extended from Pacific Avenue to California Street (as depicted on Exhibit A to <br /> this ordinance which is on file with the City Clerk's Office), unless: <br />
