INFORMATION FOR DEVELOPER: <br /> The following information is provided for the developer's benefit. These are not SEPA <br /> conditions. All requirements are preliminary in nature,and are based upon the preliminary site <br /> plan and the ordinances in effect at time of submittal for SEPA review. The proposal must <br /> comply with all ordinances in effect at the time a complete building permit application is <br /> filed,including those not specifically set forth herein. (Exception: For vesting under the <br /> Zoning Code,please refer to Section 44 of the Zoning Code). Contact the Planning Department <br /> for information regarding appeals processes for the requirements listed in this document. <br /> AGENCIES WITH JURISDICTION <br /> 1. A Construction Stormwater General Permit,administered by the Department of Ecology, <br /> will be required for this project. Additional information as well as an application form <br /> can be found on the DOE website at: <br /> www.ecy.wa.gov/proaran-is/­wq/stol-mwater/construction. <br /> APPLICABLE CONDITIONS FROM SW EVERETT MITIGATION DECISION <br /> DOCUMENT <br /> Section 1: LAND USE <br /> 1.1 Thresholds <br /> Height of Buildings/Structures <br /> Additional SEPA analysis is required for any structure that the FAA determines may have a significant adverse <br /> effect on navigable airspace around Paine Field Airport. <br /> Additional SEPA analysis is required for any project located in the M-1 zone east of Hardeson Road with a proposed <br /> building height greater than 65 feet. The analysis must assess impacts to views from the residential areas to the <br /> south and east. <br /> Permitted and Accessory Uses <br /> Tables 1-1 and 1-2 list the permitted uses and accessory uses/activities covered in this EIS analysis. <br /> 1.3 Mitigation Measures <br /> 1. Height: All development with structures more than 200 feet in height and those within 20,000 feet of Paine Field <br /> must check with the FAA to determine if notification is required. (SEPA Land and Shoreline Use Policies) <br /> 2. Rockeries and retaining walls greater than 4 feet in height and 40 feet in length that are visible from adjacent <br /> properties or public right of way shall be substantially screened with landscaping or architecturally designed <br /> and landscaped to break up the appearance of length/height in a manner approved by the Planning Director. <br /> Rockeries and retaining walls within required landscape areas shall not be counted in the required landscaping <br /> width. (SEPA Land and Shoreline Use Policies) <br /> 3. Historic and Cultural Preservation. If any archaeological resources or human remains are found during <br /> construction,the project proponent shall contact the Tulalip Tribes,the City of Everett Planning and <br /> Community Development Department,and the State Office of Archaeology and Historic Preservation. This <br /> contact will initiate a consultation process for determining subsequent actions. (SEPA Land and Shoreline Use <br /> Policies) <br />
