Stay out of areas of prostitution orders. <br /> A. Stay out of areas of prostitution orders, hereinafter known as SOAP orders, may <br /> be issued by the Everett municipal court to anyone charged with prostitution, soliciting <br /> for a lewd act, prostitution loitering or patronizing a prostitute under Chapter 10.24 of <br /> this code as a condition of pre-trial release. <br /> B. SOAP orders may be issued by the Everett municipal court to anyone convicted of <br /> prostitution, soliciting for a lewd act, prostitution loitering or patronizing a prostitute <br /> under Chapter 10.24 of this code as a condition of probation. <br /> C. Whenever a police officer shall have probable cause to believe that a person has <br /> received a SOAP order as a condition of pre-trial release or of probation and in the <br /> officer's presence is seen violating or failing to comply with any requirement or <br /> restriction imposed by the court as a condition of such pre-trial release or probation, such <br /> officer may arrest the violator without warrant or other process for violation of the SOAP <br /> order and bring said person before the court issuing the order. <br /> D. The SOAP order shall warn the person named in the order to stay out of the <br /> following high risk prostitution areas: <br /> 1. The entire area extending from the 700 block to the 1100 block of North <br /> Broadway, and two blocks east and west of this area of North Broadway; and <br /> 2. The entire area extending from the 1000 block to the 4100 block of Broadway, and <br /> two blocks east and west of this area of Broadway; and <br /> 3. The entire area of Evergreen Way extending from the 4700 block to the south city <br /> limits, and two blocks east and west of this area of Evergreen Way; and <br /> 4. The Silver Lake Rest Area on I-5 Milepost 188.09; and <br /> 5. The entire area extending from the 1000 block to the 3200 block of Hewitt Avenue <br /> and two blocks north and south of this area of Hewitt Avenue; and <br /> 6. The entire area extending from the 2500 block to the 4100 block of Colby Avenue, <br /> and two blocks east and west of this area of Colby Avenue; and <br /> 7. The entire area extending from Everett Avenue to the 4600 block of Rucker <br /> Avenue, and two blocks east and west of this area of Rucker Avenue; and <br /> 8. The entire area extending from the 1000 block to the 3000 block of Pacific <br /> Avenue, and two blocks north and south of this area of Pacific Avenue; and <br /> 9. The entire area extending from the 1000 block to Everett Avenue of West Marine <br /> Drive, and two blocks west of this area of West Marine View Drive. <br /> E. A person is deemed to have notice of the SOAP order when: <br /> 1. The signature of the person named in the order or their attorney is affixed to the <br /> bottom of the order, signifying that they have read the order and have knowledge of the <br /> contents of the order; or <br /> 2. The order recites that the person named in the order or the person's attorney <br /> appeared in person before the court. <br /> F. The written SOAP order shall contain the court's directives and shall bear the <br /> legend: "Violation of this order is a criminal offense under Chapter 10.24 EMC and will <br /> subject a violator to arrest." <br /> G. Whenever a SOAP order is issued under this section, and the person named in the <br /> order knows of the order, a violation of any of the provisions of the order is a gross <br /> misdemeanor. Upon the first such conviction, the person shall be punished by <br /> imprisonment for not less than ten days and a fine of not less than two hundred fifty <br /> 2 <br />
