f <br /> '1 <br /> ORDINANCE NO. 3053-08 <br /> An Ordinance amending the Shoreline Master Program, Comprehensive Plan and <br /> Zoning Code to update the shoreline designation maps and accompanying text to be <br /> consistent with updated FEMA Flood Insurance Rate Maps, by Amending Exhibit A to <br /> Ordinance No. 2600-02, as Amended (Shoreline Master Program), Exhibit A to <br /> Ordinance No. 2021-94 (Comprehensive Plan) and Exhibit A to Ordinance No. 1671-89, <br /> as Amended (Zoning Code) <br /> WHEREAS, the City of Everett and the Washington State Department of Ecology <br /> approved an updated Shoreline Master Program for the City of Everett which became <br /> effective in May 2002 and which has subsequently been amended; and <br /> WHEREAS, the City adopted recently updated FEMA flood insurance rate maps and <br /> modified the floodplain management ordinance in the Zoning Code and floodplain <br /> management regulations in the Shoreline Master Program through the adoption of <br /> Ordinance Nos. 2856-05 and 2857-05; and <br /> WHEREAS, it is the intent of this ordinance to make the necessary revisions to the <br /> Zoning Code and Shoreline Master Program so that they are consistently and accurately <br /> mapped flood prone areas; and <br /> WHEREAS, the proposed amendments were reviewed under the State Environmental <br /> Policy Act and a Determination of Nonsignificance was issued for the amendments; and <br /> WHEREAS, the Growth Management Act, RCW 36.70A.130 provides that the goals <br /> and policies of the shoreline master program shall be considered an element of the City's <br /> comprehensive plan, and the other portions of the shoreline master program shall be <br /> considered part of the City's development regulations; and <br /> WHEREAS, the Growth Management Act, RCW 36.70A.130 authorizes the City to <br /> amend the comprehensive plan in order to adopt or amend shoreline master programs at <br /> any time; and <br /> WHEREAS, the City Council conducted a public hearing to review the <br /> recommendations of the Planning Commission and to take additional public testimony; <br /> and <br /> WHEREAS, the City Council finds: <br />
