WHEREAS, the City Council has conducted a public hearing to consider the recommendations <br /> of the Planning Commission; and <br /> WHEREAS, the City Council finds that the proposed updates to the City's Shoreline Master <br /> Program and shoreline use regulations will protect human health, safety and the environment, <br /> bear a substantial relation to the public interest and are in the best long term interests of the <br /> Everett Community. <br /> NOW, THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION 1: That Section 3.6 of the Shoreline Master Program, adopted in Section 1 of <br /> Ordinance No. 2600-02, which reads in part as follows: <br /> Consistent with WAC 173-26-190 the City hereby incorporates the following regulations into the <br /> Shoreline Master program. <br /> • EMC 19.30 Floodplain Overlay Districts and Regulations in effect on March 7, 2001 as <br /> modified to comply with FEMA's letter of October 27, 1999 and/or additional FJ MA <br /> requirements based upon the 2001 Snohomish River floodplain modeling efforts. Such <br /> additional changes may require revisions to the SMP. <br /> 33E AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: <br /> Consistent with WAC 173-26-190 the City hereby incorporates the following regulations into the <br /> Shoreline Master program. <br /> • EMC 19.30 Floodplain Overlay Districts and Regulations and EMC 19.4.030 Floodplain <br /> Overlay Zone Definitions as updated in 2005. <br /> SECTION 2: That Regulation #2 of Section 3.6 of the Shoreline Master Program, adopted in <br /> Section 1 of Ordinance No. 2600-02 and codified in as EMC 19.33D.070.A.2, which reads as <br /> follows: <br /> All development in the Flood Fringe and Floodway overlay zones shall comply with EMC 19.30, <br /> as applicable. In addition, all development located downriver from SR 529, shall be <br /> floodproofed in accordance with the provisions in EMC 19.30.040C, as applicable. <br /> BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: <br /> Areas of special flood hazard shall be governed by the provisions of EMC 19.30. <br /> SECTION 3: That Figure 4-XX of the Shoreline Master Program, adopted in Section 1 of <br /> Ordinance No. 2600-02 and codified in EMC 19.33D, be amended as shown in the attached <br /> updated shoreline maps. <br /> 2 <br />
