TO: City Clerk <br /> David Pater, Ecology <br /> FROM: Mary Cunningham <br /> DATE: May 14, 2010 <br /> SUBJECT: Additional Scrivener's Errors <br /> Ordinance No. 3053-08 was approved by Ecology and became effective on December 29, 2009. <br /> While preparing replacement pages, we found the following scrivener's errors on the maps <br /> adopted in Section 9 of the Ordinance: <br /> • Figures 4.1, 4.4 and 4.7. Designations for the portion of Smith Island outside the City <br /> limits and within the Urban Growth Boundary were not shown correctly. The Urban <br /> Mixed use Industrial Designation extends to the urban growth boundary line in effect <br /> when the original SMP was adopted. (See the language in Section 3 of the ordinance that <br /> was not modified.) That line runs approximately along the western edge of Smith Island. <br /> The designation was shown correctly in Figure 4.4. Note that a June 10, 2008 memo <br /> from John Jimerson included a revised map that corrected a different problem with <br /> Figures 4.4 and 4.7 (taking out properties located more than 200 feet from the OHWM <br /> and not within the flood plain). The attached Figures 4.4 and 4.7 should replace those <br /> included in that memo. <br /> • Figure 4.13. The word "applies" was left out of the last sentence in the bottom note box. <br /> • Figure 4.14. The figure did not show the 100 year flood plain on the southern portion of <br /> the Simpson site. <br /> The corrected figures are attached. The corrections do not alter the policies or regulations to be <br /> applied to these properties. <br /> Note that since the SMP was adopted, Snohomish County expanded the UGA further west into <br /> the bay. The City will process another SMP amendment to designate the aquatic areas within the <br /> expanded UGA. <br />
