14111WI <br /> RESOLUTION NO. 6761 <br /> A RESOLUTION authorizing recovery of abatement costs <br /> pursuant to EMC 1.20.090 at 1101 E Marine View Drive, Everett, Washington. <br /> WHEREAS,the Everett Municipal Code (the "EMC") Section 1.20.090 authorizes the <br /> City to abate code violations and recover the abatement costs; and <br /> WHEREAS, on February 20, 2014, the City of Everett Violations Hearing Examiner <br /> issued an Order against the property owners Andrew G. Armitage and Karen D. Loth (the <br /> "Owners") for EMC violations at 1101 E Marine View Drive (the "Property"), parcel number <br /> 00438322800100, and abbreviated legal description: <br /> EVERETT DIV 0 PLAT OF BLK 228 D-00—LOT 1 <br /> WHEREAS the Owners failed to abate the violations, including removing the discarded <br /> appliances, household equipment, boxes, crates, personal property, yard tools, bicycle parts, <br /> metal items and salvage materials on the Property by the date set by the Order; <br /> WHEREAS, Owner Loth signed a request for abatement, right of entry and waiver and <br /> release allowing the City to enter the Property and conduct the abatement of the above-described <br /> violations at the sole cost of the Owners, and that those costs together with any penalties <br /> imposed by the Hearing Examiner may become a lien against his property if the Owners failed to <br /> reimburse the City the abatement costs; <br /> WHEREAS,the City,through a contractor, conducted the abatement and secured the <br /> structure from trespass on April 22, 2014; <br /> WHEREAS,the City incurred costs in the amount of$4,651.44 in its abatement of the <br /> violations and the Hearing Examiner imposed a penalty of$1,000.00 against the owners; <br /> WHEREAS,the Owners have failed to timely pay the penalty and abatement costs; and <br /> WHEREAS, notice of Council's consideration of this Resolution was provided to the <br /> Owners; <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Everett that the <br /> costs and penalties set forth in the report attached hereto is confirmed for the Property. The City <br /> Treasurer is authorized to certify the amount due and owing to the County Treasurer, which <br /> amount shall then be entered as an assessment upon the tax rolls against the Property with <br /> interest as provided by law. <br /> 1 <br />
