4 <br /> Applicable Law: <br /> 1. EMC 8.20.020 Nuisances,which reads: <br /> No person owning, leasing, renting, occupying or having charge or possession of <br /> any property in the city, including vacant lots, shall maintain or allow to be <br /> maintained on such property except as may be allowed by any other city ordinance <br /> any of the following conditions visible from any public street, alley or other public or <br /> private property: <br /> (A) Junk, trash, litter, boxes, discarded lumber or salvage materials or other similar <br /> materials in any front yard, side yard, rear yard or vacant lot. <br /> (C) Broken or discarded furniture, household equipment and furnishings in any front <br /> yard, side yard, rear yard or vacant lot. <br /> (G) Vehicle parts or other articles or personal property which are discarded or left in <br /> a state of partial construction or repair in any front yard, side yard, rear yard or <br /> vacant lot. <br /> 2. EMC §1.20.010(E) Repeat Violator: <br /> "Repeat violator"means any person, firm, corporation, association, or agent thereof <br /> who has had any order issued pursuant to the provisions in this chapter, including <br /> any order issued subsequent to a hearing, any stipulated order and any default <br /> order, and within twenty-four months of the issuance of such order commits or <br /> allows to be committed a new and separate violation of a same or similar chapter of <br /> the Everett Municipal Code that is enforceable under this chapter, regardless of <br /> location. <br /> Conclusions of Law Based on Above Findings: <br /> 1. By allowing discarded appliances, household equipment, boxes, crates, personal <br /> property, yard tools, bicycle parts, metal items and salvage materials to accumulate <br /> and remain on the property, the Respondents violated EMC 8.20.020(A)(C)(G). <br /> These violations are a public nuisance. <br /> 2. The Examiner held that the Respondents violated EMC 8.20.020(A)(G) on July 26, <br /> 2012. The Respondents are repeat violators because they violated a similar Code <br /> chapter within the past twenty-four months. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, it is hereby <br /> determined that the Respondents are in default and are in violation of EMC 8.20.020 <br /> (A)(C)(G) and are hereby ordered to: <br /> 1. The Respondents shall properly and legally abate all violations of EMC <br /> 8.20.020(A)(C)(G) on the property located at 1101 East Marine View Drive, Everett, <br /> Washington. <br />
