2 <br /> Exhibit 8 Snohomish County Assessors Record dated February 13, 2014 <br /> Exhibit 9 Go Sync Maps <br /> Exhibit 10 Exhibit List dated February 20, 2014 <br /> Based upon a review of the above record, the following Findings of Fact and <br /> Conclusions of Law hereby constitute the basis of the decision of the City of Everett <br /> Violations Hearing Examiner. <br /> FINDINGS OF FACT <br /> 1. Andrew G. Armitage and Karen D. Loth, Respondents, are the owners of record of <br /> property at 1101 East Marine View Drive, Everett, Washington (property). The <br /> property is in an R-2 Single Family Detached Medium Density zone as established <br /> by the City of Everett. (Exhibit#8, Snohomish County Assessors Record dated <br /> February 13, 2014) (Exhibit#9, Go Sync Maps) <br /> 2. On July 26, 2012, nineteen (19) months prior to the hearing date on the instant <br /> violation, an Order was issued by the Everett Hearing Examiner against the <br /> Respondents for nuisance violations on the property. The Order required the <br /> Respondents to remove and properly dispose of all discarded junk, trash, litter and <br /> vehicle parts from the property. in addition, the Respondents were required to <br /> obtain a building permit from the City for work that had been completed without a <br /> permit. (Exhibit#6, Final Findings of Fact, Conclusion of Law and Order of the <br /> Hearing Examiner Case#CE12-0080 dated July 26, 2012) (Testimony of Code <br /> Enforcement Officer Keirsey) <br /> 3. On January 2, 2014, Everett Code Enforcement(ECE) Officer Cindy Keirsey <br /> inspected the property and observed and photographed that bagged garbage had <br /> been discarded in the backyard of the property in view from neighboring properties. <br /> Such violations are an annoyance and disrupt and injure the comfort, repose, health <br /> and safety of others. The entire community is affected by the activity. (Exhibit#2z- <br /> 2aa, Inspection Photos dated January 2, 2014) (Testimony of Code Enforcement <br /> Officer Keirsey) <br /> 4. On January 7, 2014, ECE Officer Keirsey reinspected the property and observed <br /> and photographed that the bagged trash had been removed from the backyard, but, <br /> a vehicle engine had been discarded near a truck on site. (Exhibit#2x-2y, <br /> Inspection Photos dated January 7, 2014) (Testimony of Code Enforcement Officer <br /> Keirsey) <br /> 5. On January 8, 2014, a notice to comply was sent to the Respondents via first class <br /> mail. The letter advised the Respondents that the condition of the property was in <br /> violation of the Everett Municipal Code (EMC) and provided a corrective action date <br /> of January 16, 2014 to abate the violations. On January 21, 2014, ECE Officer Keirsey reinspected the property and observed <br /> and photographed that bagged trash, bicycle parts, buckets, barrels and household <br />
