SECTION 3: INSTALLATIONS AND SERVICE APPOINTMENTS <br /> A. All installations will be in accordance with FCC rules, including but not limited <br /> to, appropriate grounding, connection of equipment to ensure reception of Cable Service, and the <br /> provision of required consumer information and literature to adequately inform the Subscriber in <br /> the utilization of Franchisee-supplied equipment and Cable Service. <br /> B. The Standard Installation shall be performed within seven (7) business days after <br /> an order is placed if the Optical Network Terminal ("ONT") is already installed on the <br /> customer's premises. The Standard Installation shall be performed within fourteen (14) business <br /> days where there is no ONT at the time of service order. Franchisee shall meet this standard for <br /> ninety-five percent (95%) of the Standard Installations it performs, as measured on a calendar <br /> quarter basis, excluding those requested by the customer outside of these time periods. <br /> C. The Franchisee shall provide the City with a report upon request from the City, <br /> but in no event more than once a quarter, noting the percentage of Standard Installations <br /> completed within the time periods provided in Section 3.B. Subject to consumer privacy <br /> requirements, underlying activity will be made available to the City for review upon reasonable <br /> request. <br /> D. At Franchisee's option, the measurements and reporting above may be changed <br /> from calendar quarters to billing or accounting quarters one time during the term of this <br /> Agreement. Franchisee shall notify the City of such a change not less than thirty (30) days in <br /> advance. <br /> E. Franchisee will offer Subscribers "appointment window" alternatives for arrival <br /> to perform installations, Service Calls and other activities of a maximum four (4) hours <br /> scheduled time block during appropriate daylight available hours, usually beginning at 8:00 AM <br /> unless it is deemed appropriate to begin earlier by location exception. At Franchisee's <br /> discretion, Franchisee may offer Subscribers appointment arrival times other than these four (4) <br /> hour time blocks, if agreeable to the Subscriber. These hour restrictions do not apply to <br /> weekends. <br /> (1) Franchisee may not cancel an appointment window with a customer after <br /> the close of business on the business day prior to the scheduled appointment. <br /> (2) If Franchisee's representative is running late for an appointment with a <br /> customer and will not be able to keep the appointment as scheduled, the customer will be <br /> contacted. The appointment will be rescheduled, as necessary, at a time which is convenient for <br /> the customer. <br /> F. Franchisee must provide for the pick up or drop off of equipment free of charge in <br /> one of the following manners: (i) by having a Franchisee representative going to the Subscriber's <br /> residence, (ii) by using a mailer, or (iii) by establishing a local business office within the <br /> Franchise Area. If requested by a mobility-limited customer, the Franchisee shall arrange for <br /> pickup and/or replacement of converters or other Franchisee equipment at Subscriber's address <br /> or by a satisfactory equivalent. <br /> EVERETT 27 <br /> Seattle-3388207.8 0010932-00119 <br />
