C. This Agreement is entered into pursuant to RCW 36.70B.170, .180, and .190. <br /> The purpose of this Agreement is to ensure only uses listed in either the B-1 zone or <br /> those listed herein this Agreement, and that henceforth development of the site shall be guided <br /> by B-2 zone standards. <br /> D. The parties hereto agree, as conditioned by this Agreement, that the Owners <br /> satisfy the criteria for approval of the rezone of the property described herein to B-2 (Community <br /> Business), so long as they adhere to the provisions, specifically the allowed uses found herein, as <br /> found at EMC Chapter 19.06.010,per Development Standards and other relevant sections of the <br /> Everett Municipal Code. <br /> E. Any site and building development not specified by this Agreement shall be <br /> subject to applicable zoning regulations in effect at the time building permits are issued, as <br /> determined by the Planning Director. <br /> PART ONE—PROPERTY USE <br /> 1.1 SEPA. The provisions of this Agreement are subject to the City's SEPA <br /> Determination(EIS 07-002), which is incorporated herein by reference. <br /> 1.2 Restricted Use. Pursuant to City Council Ordinance No. , the subject B-2 <br /> (Community Business) zoned property is restricted to the following uses, in addition to those <br /> used allowed in the previous B-1 (Neighborhood Shopping)zone: <br /> a. Sale of hard liquor(in association with restaurant use only), <br /> b.Appliance Service and sales(with no associated fleet of service vehicles), <br /> c.Carpet Sales, <br /> d.Dry Cleaner, <br /> e.Furniture Sales, <br /> f.Health and Fitness, <br /> g.Laundromat, <br /> h.Personal Services(tailor,beauty salon), <br /> i.Retail—Indoor, <br /> j .Micro Brewery, <br /> k.Vocational Training(limited to 4,000 square feet of classroom space), <br /> 1.Printing Duplicating, <br /> m.Vet Clinic(no pet boarding). <br /> 2 <br />
