WHEREAS, City Council held a public hearing to consider the request at which time it took <br /> additional public testimony and heard presentations from staff and the applicant on August 20, <br /> 2008, after which the City Council made the final decisions as reflected by this Ordinance; and <br /> WHEREAS, CITY COUNCIL FINDS: <br /> 1. As a property owner Dujardin has identified the need to expand limited use of his property <br /> and has determined that the desired limited uses are allowed n the B-2 zone. <br /> 2. The requested amendment to the Comprehensive Plan is supported by Land Use Policy <br /> 2.1.3. which will, "Require new commercial development(at the subject site)to be more <br /> pedestrian friendly and compatible with transportation service." And Policy 2.2.4, which will, <br /> through use of B-2 zoning, "Adopt standards to promote well designed commercial developments <br /> and proper maintenance of commercial properties to improve and reinforce the quality and <br /> character of the commercial district and surrounding neighborhoods." <br /> 3. Circumstances related to the subject property and the area in which it is located have <br /> changed sufficiently since the adoption of the Land Use Element to justify a change to the <br /> proposed land use designation. Specifically: (1) local roadway reconfiguration has changed, and <br /> (2) growth in the area and resulting elevated local demand for services have increased. <br /> 4. The purpose for the requested Comprehensive Plan amendment and rezone is to allow <br /> Dujardin to expand uses at the site, consistent with his willingness to accept limits those uses in <br /> order to minimize disruption to nearby residential areas. <br /> 5. To achieve the requested land use changes and related provisions, City Council needs to: <br /> a. Amend the Comprehensive Plan map from 4.3 (Office)to 4.4 (Mixed Use Commercial - <br /> Multiple Family) as depicted in Exhibit A, and <br /> b. Rezone the site from B-1 (Neighborhood Shopping) to B-2 (Neighborhood Business), <br /> as depicted in Exhibit B. <br /> 6. The Draft Supplemental Environmental Impact Statement (DSEIS) for the 2007 <br /> Comprehensive Plan docket cycles reviewed Dujardin's proposal and identified impacts of <br /> changing the land use designation and rezoning and addressed those impacts. <br /> 7. The Planning Commission reviewed the proposed Comprehensive Plan amendment and rezone as <br /> presented in staff reports and heard public input at public hearings on November 27, 2007, April 7, 2008 <br /> and June 2, 2008, and subsequently recommended approval of the proposal at the June 17th public <br /> hearing. <br /> 2 <br />
