Section 6: Rates and charges for the Solid Waste Management Utility shall be subject to reduction for low income senior and low income disabled citizens as provided in Ordinance No. 2908-06 or as such may be amended. Section 7: Rates will be subject to review by City Council at such time as outstanding debt has been retired. Section 8: The Mayor is authorized to establish reasonable rules, regulations and procedures in connection with collection of rates and charges for the City of Everett Solid Waste Management Utility. Section 9: Ordinance No. 2988-07 is hereby repealed. Section 10: The enactment of this ordinance shall not affect any case, proceeding, or appeal, or other matter in any court of before the City or in any way modify any rate, charge, obligation, right or liability, civil or criminal, which may be in existence on the effective date of this ordinance or as may exist by virtue of any of the ordinance herein superseded or repealed. Section 11: If any section, sentence, clause, or phrase (i.e., provision) of this ordinance or its application to any person or circumstance is held invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other provision, and the remainder of this ordinance, or the application of such provision to other persons or circumstances, shall not be affected. Section 12: The City Clerk and codifiers of this ordinance are authorized to make necessary corrections to this ordinance including, but not limited to, the correction of scrivener's/clerical errors, references, ordinance numbering, section/subsection number and any references thereto.
