ORDINANCE NO. 2736-03mii011811/1. 12d.24 <br /> AN ORDINANCE Amending the Shoreline Master Program to Provide for <br /> Piers and Docks for Transportation Facilities of Statewide Significance in the Aquatic <br /> Conservancy Environment, Amending the Everett Comprehensive Plan and Zoning Code, <br /> Amending Ordinance No 2021-94 and Ordinance No. 1671-89, as Amended by Ordinance No. <br /> 2600-02 and Repealing Ordinance No. 2707-03 <br /> WHEREAS, in April 2002 the City Council approved an updated Shoreline Master Program <br /> (SMP) in Ordinance No. 2600-02; and <br /> WHEREAS, the Washington Department of Ecology approved the SMP, and the update became <br /> effective on May 3, 2002; and <br /> WHEREAS, the regulations and environment designations in the SMP were adopted as part of <br /> the Zoning Code (Shoreline Overlay District), and the goals and policies were adopted as part of <br /> the Comprehensive Plan; and <br /> WHEREAS, during the process to update the SMP, the City identified changes to the <br /> Comprehensive Plan and Zoning Code that would be required to implement the SMP, including <br /> providing for transportation facilities; and <br /> WHEREAS, the Shoreline Management Act authorizes the City of Everett to amend its <br /> Shoreline Master Program; and <br /> WHEREAS,the Port of Everett requested a revision to the Shoreline Master Program <br /> regulations to provide for piers and docks for transportation facilities in the Aquatic Conservancy <br /> shoreline environment; and <br /> WHEREAS, the Shoreline Master Program provides transportation facilities in all shoreline <br /> environments, but only allows piers and docks for public access uses in the Aquatic Conservancy <br /> environment; and <br /> WHEREAS,the Shoreline Master Program does not distinguish between transportation facilities <br /> of statewide significance and other/local transportation facilities; and <br /> WHEREAS, the City limited the Port's proposed revision to transportation facilities of <br /> statewide significance as defined in other proposed Comprehensive Plan and Zoning revisions; <br /> and <br />
