Section 17. General Authorization; Ratification of Prior Acts. The Mayor, the Finance <br /> Director, the City Clerk and other appropriate officers of the City are authorized to take any <br /> actions and to execute documents as in their judgment may be necessary or desirable in order to <br /> carry out the terms of, and complete the transactions contemplated by, this ordinance. All acts <br /> taken pursuant to the authority of this ordinance but prior to its effective date are hereby ratified. <br /> Section 18. Amending Section 2 of Ordinance No. 2663-02). Section 2 of Ordinance <br /> No. 2663-02 shall be amended to read as follows (deletions are shown as stricken text and <br /> additions are shown as underscored): <br /> The City is acquiring, constructing and equipping a public space building <br /> adjacent to the Everett Special Events Center and contributing funds to pay for <br /> certain public improvements and upgrades at the Everett Special Events Center <br /> [and, if funds are sufficient, the City, upon the approval of the City Council= <br /> shall acquire, construct and undertake other capital renovations, additions <br /> and improvements to City facilities and infrastructure] ([collectively, ]the <br /> "Project"). The public space building will be owned by the City. The <br /> construction of the [Everett Special Events Center and public space building <br /> components of the ]Project and other details relating to [its][Proicct] <br /> management shall be set forth in an interlocal agreement between the City and the <br /> Everett Public Facilities District. $15,000,000 of the cost of the Project will come <br /> from the Improvement Bonds hereinafter authorized. <br /> As amended by this ordinance, Ordinance No. 2663-02 is hereby ratified, approved and <br /> confirmed. <br /> Section 19. Severability. In the event that any one or more of the provisions of this <br /> ordinance shall for any reason be held to be invalid, such invalidity shall not affect or invalidate <br /> any other provision of this ordinance or the Notes, but this ordinance and the Notes shall be <br /> construed and enforced as if such invalid provision had not been contained herein; provided, <br /> however, that any provision which shall for any reason be held by reason of its extent to be <br /> invalid shall be deemed to be in effect to the extent permitted by law. <br /> -15- P:\CMW\CMW634 03/12/08 <br />
