Agent, the Tender Agent, the Calculation Agent, if any, the Liquidity Facility Provider, if any, <br /> and the Credit Facility Provider, if any, by Electronic Notice not fewer than 10 days prior to the <br /> applicable Purchase Date. <br /> (f) If, following the giving of notice of mandatory tender of Bonds pursuant to <br /> Section 3.10, an event occurs which, in accordance with the terms of this ordinance causes such <br /> mandatory tender not to occur, then (1) the Bond Registrar shall so notify the Registered Owners <br /> of such Bonds (at their addresses as they appear on the Bond Register on the date of such notice), <br /> by Electronic Notice, confirmed by first class mail, as soon as may be practicable before the <br /> applicable Purchase Date, and (2) the Tender Agent shall return to their Registered Owners any <br /> such Bonds tendered to the Tender Agent in connection with such mandatory tender of such <br /> Bonds. <br /> (g) During any Variable Rate Period, on any Business Day designated by the City, <br /> and during any Index Floating Rate Period, on any Par Call Date designated by the City, in each <br /> case with the consent of the Liquidity Facility Provider, if any (each a "City Elective Purchase <br /> Date"), the Bonds are subject to mandatory tender for purchase at the Purchase Price, payable in <br /> immediately available funds. Such City Elective Purchase Date shall be a Business Day not <br /> earlier than the 10th day following the second Business Day after receipt by the Tender Agent of <br /> such designation. If on a City Elective Purchase Date sufficient remarketing proceeds or other <br /> amounts provided by the City are not available for the purchase of all Bonds, then the City's <br /> designation of such City Elective Purchase Date shall be deemed rescinded, and the City shall <br /> have no obligation to purchase the Bonds tendered or deemed tendered on the City Elective <br /> Purchase Date. The Bond Registrar shall give Electronic Notice of such rescission to the <br /> Registered Owners, with a copy to the City, the Tender Agent, the Remarketing Agent and the <br /> -72- P\20287 CMVN20287 AMT 10/14/14 <br />
