8. To date, the City has had extremely limited experience with one marijuana <br /> business operating within the City and has had no experience with the potential cumulative <br /> effects of 22 marijuana businesses operating within the City; and <br /> 9. Pending litigation may potentially limit the City's ability to zone marijuana <br /> businesses; and <br /> 10. The state legislature is likely to take action during the next legislative session <br /> which may integrate the medical marijuana system into the recreational system or which may <br /> limit the City's ability to zone marijuana businesses; and <br /> 11. Substantial uncertainty exists as to the appropriate and necessary zoning for <br /> marijuana businesses; and <br /> 12. The City's interim zoning regulations expire on November 9, 2014; and <br /> 13. Modifying and extending the current interim zoning regulations will continue to <br /> allow the City to take a measured approach which honors the spirit of state law and acts as a pilot <br /> project allowing marijuana businesses only in areas that have the greatest likelihood to be <br /> permissible areas after full consideration of the proper regulation of marijuana businesses and <br /> experience with the impacts of such businesses; and <br /> 14. A State Environmental Policy Act, RCW 43.21C, Final Determination of Non <br /> Significance (SEPA#14-031) for the regulation of marijuana businesses was issued on <br /> September 3, 2014; and <br /> 15. The Planning Commission held a public workshop on the potential for <br /> establishing zoning regulations for recreational marijuana businesses on September 2, 2014, and <br /> a public hearing on September 16, 2014, to consider public testimony concerning renewal of <br /> interim zoning regulations for recreational marijuana businesses. <br /> 16. The City held a public hearing on the date of adoption of this Ordinance; and <br /> 17. Nothing in this Ordinance is intended to encourage any use or activity that <br /> violates federal law; and <br /> Whereas,the City Council concludes that: <br /> 1. The City does have the authority to modify and readopt renew regulations; and <br /> 2. The City must adopt interim regulations concerning the location of recreational <br /> marijuana businesses to act as a stop-gap measure: (a)to protect the City's interests in the face of <br /> substantial uncertainty related to the zoning and regulations of recreational marijuana businesses, <br /> Page 2 of 6 <br />
