,41P46/0111""'"4 <br /> ORDINANCE NO. 3104-08 <br /> AN ORDINANCE relating to the General Provisions of the License Code, amending <br /> Chapter 1 Section 3 of Ordinance No. 295-74, as amended by Section 1 of Ordinance No. <br /> 885-82 (EMC 5.04.030), Chapter 1 Section 4 of Ordinance No. 295-74 (EMC 5.04.040), <br /> Chapter 1 Section 5 of Ordinance No. 295-74 (EMC 5.04.050), Chapter 1 Section 6 of <br /> Ordinance No. 295-74 (EMC 5.04.060) and Chapter 1 Section 7 of Ordinance No. 295-74 <br /> (EMC 5.04.070). <br /> WHEREAS, law enforcement records checking systems can no longer be used to <br /> research backgrounds of applicants for licenses; and <br /> WHEREAS, the necessary background investigations into license applicants must <br /> now be done via the Washington State Patrol "W.A.T.C.H." system, incurring a cost of <br /> ten dollars per inquiry, which the City will in turn require the license applicant to pay; <br /> and <br /> WHEREAS, driving record investigations, when necessary for issuance of a license <br /> under the License Code, must now be done via a requirement that the applicant provide <br /> the Clerk with a current abstract of driving record; and <br /> WHEREAS, the Police Department and City Clerk have jointly recommended other <br /> changes to the license application procedures set forth in Chapter 5.04 of the Everett <br /> Municipal Code "General Provisions"; and <br /> WHEREAS, first class cities have the power to grant licenses for any lawful purpose, <br /> and to fix by ordinance the amount to be paid therefor, <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Chapter 1, Section 3 of Ordinance No. 295-74, as amended by Section 1 of <br /> Ordinance No. 885-82 (EMC 5.04.030), which reads as follows: <br /> General requirements for all licenses. <br /> A. The general requirements relating to all licenses in this title are as follows: <br /> 1. No person shall make false statements in the application; <br /> 2. No license shall enable any person to engage in any dishonest, unlawful or <br /> unfair act, practice or enterprise; <br />
