• ORDINANCE NO. 2748-04 AN ORDINANCE Relating to Communication with Minors for Immoral Purposes, Amending Section 104 of Ordinance No. 1145-85 (EMC 10.32.040). WHEREAS the 2003 State Legislature amended the crime of Communication with a Minor for Immoral Purposes to clarify that the law applies to a person who communicates with a minor for immoral purposes and to a person who communicates with someone who he/she believes to be a minor for immoral purposes; and WHEREAS, the City of Everett City Council deems it appropriate for the City Criminal Code to be consistent with state law in this area. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: Section 104 of Ordinance No. 1145-85 (EMC 10.32.040), which reads as follows: Communication with minor for immoral purposes. A person who communicates with a minor for immoral purposes is guilty of a gross misdemeanor. is hereby amended to read as follows: Communication with minor for immoral purposes. A person who communicates with a minor for immoral purposes, or a person who communicates with someone the person believes to be a minor for immoral purposes, is guilty of a gross misdemeanor. Section 2. Third Party Liability It is expressly the purpose of this ordinance to provide for and promote the health, safety and welfare of the general public and not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefited by the terms of this ordinance. It is the specific intent of this ordinance that no provisions nor any term used in this ordinance is intended to impose any duty whatsoever upon the City or any of its officers or employees, for whom the implementation and enforcement of this ordinance shall be discretionary and not mandatory. 1
