• <br /> ORDINANCE NO. 2748-04 <br /> AN ORDINANCE Relating to Communication with Minors for Immoral <br /> Purposes, Amending Section 104 of Ordinance No. 1145-85 (EMC 10.32.040). <br /> WHEREAS the 2003 State Legislature amended the crime of Communication with a <br /> Minor for Immoral Purposes to clarify that the law applies to a person who communicates <br /> with a minor for immoral purposes and to a person who communicates with someone <br /> who he/she believes to be a minor for immoral purposes; and <br /> WHEREAS, the City of Everett City Council deems it appropriate for the City Criminal <br /> Code to be consistent with state law in this area. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 104 of Ordinance No. 1145-85 (EMC 10.32.040), which reads as <br /> follows: <br /> Communication with minor for immoral purposes. <br /> A person who communicates with a minor for immoral purposes is guilty of a gross <br /> misdemeanor. <br /> is hereby amended to read as follows: <br /> Communication with minor for immoral purposes. <br /> A person who communicates with a minor for immoral purposes, or a person who <br /> communicates with someone the person believes to be a minor for immoral purposes, is <br /> guilty of a gross misdemeanor. <br /> Section 2. Third Party Liability <br /> It is expressly the purpose of this ordinance to provide for and promote the health, safety <br /> and welfare of the general public and not to create or otherwise establish or designate any <br /> particular class or group of persons who will or should be especially protected or <br /> benefited by the terms of this ordinance. <br /> It is the specific intent of this ordinance that no provisions nor any term used in this <br /> ordinance is intended to impose any duty whatsoever upon the City or any of its officers <br /> or employees, for whom the implementation and enforcement of this ordinance shall be <br /> discretionary and not mandatory. <br /> 1 <br />
