I <br /> I <br /> 1 trucks equal or less than the number of DBE trucks the firms owns or <br /> 2 has leased/subcontracted through another DBE trucking company. <br /> 3 The DBE must control the work of the non-DBE trucks. If the non- <br /> 4 DBE is performing the work without supervision of that work by the <br /> 5 DBE, the DBE is not performing a Commercially Useful Function <br /> 6 (CUF). I <br /> 7 <br /> 8 6. In any lease or owner-operator situation, as described in requirement <br /> 9 #4 and #5 above, the following rules shall apply: I <br /> 10 <br /> 11 a. A written lease/rental agreement is required for all trucks <br /> 12 leased or rented; documenting the ownership and the terms <br /> 13 of the agreement. The agreements must be submitted and <br /> 14 approved by the Contracting Agency prior to the beginning <br /> 15 of the Work. The agreement must show the leaser's name, <br /> 111 <br /> 16 truck description and agreed upon amount and method of <br /> 17 payment (hour, ton, or per load). All lease agreements shall <br /> 18 be for a long-term relationship, rather than for the individual <br /> 19 project. (This requirement does not apply to owner-operator <br /> 20 arrangements.) <br /> 21 <br /> 22 b. Only the vehicle, (not the operator) may be leased or rented. 1 <br /> 23 (This requirement does not apply to owner-operator <br /> 24 arrangements). <br /> 25111 26 7. Credit may only be claimed for DBE trucking firms operating under a <br /> 27 subcontract or a written agreement approved by the Contracting <br /> 28 Agency prior to performing Work. <br /> 29 <br /> 30 Expenditures paid to other DBEs <br /> 31 Expenditures paid to other DBEs for materials or supplies may be counted <br /> 32 toward DBE goals as provided in the following: <br /> 33 <br /> 34 Manufacturer <br /> 35 You may claim DBE credit for 100 percent of value of the materials or <br /> 36 supplies obtained from a DBE manufacturer. <br /> 37 <br /> 38 A manufacturer is a firm that operates or maintains a factory orII <br /> 39 establishment that produces, on the premises, the materials, supplies, <br /> 40 articles, or equipment required under the contract. A manufacturer shall <br /> 41 include firms that produce finished goods or products from raw or <br /> 42 unfinished material or that purchases and substantially alters goods and <br /> 43 materials to make them suitable for construction use before reselling <br /> 44 them.
