Section 002113 <br /> Instructions to Bidders <br /> C. Bid security shall serve as evidence of good faith and as a guarantee that if awarded the <br /> Contract the Bidder will execute the Contract and provide bonds as required by the Bid. <br /> Should the successful Bidder fail to enter into the Contract, furnish a satisfactory <br /> performance and payment bond, and furnish evidence of insurance within 14 calendar days <br /> after the award date, the certified check, cashier's check or bid bond shall be forfeited as <br /> liquidated damages. <br /> 1.10 List of Subcontractors <br /> Bidder shall complete SECTION 004336 - SUBCONTRACTORS FORM and submit it with the <br /> Bid. <br /> 1.11 Rejection of Any and All Bids <br /> The City reserves the right to reject any and all Bids. <br /> 1.12 Return of Bid Security <br /> Within 15 calendar days after the Bids are opened, the City will return the bid security <br /> accompanying the Bids that are not to be considered in making the award. All other bid <br /> securities will be held until the Contract has been fully executed; after which they will be <br /> returned to the respective Bidders whose Bids they accompanied. <br /> 1.13 Award of Contract <br /> A. EVALUATION OF BIDS <br /> 1. Bids will be evaluated by the City to determine which bid is the lowest responsive bid by <br /> a responsible bidder and which bid, if any, should be accepted in the best interest of the <br /> City. The City, in its sole discretion, reserves the right to accept or reject any and all bids <br /> submitted and to waive informalities and minor irregularities. <br /> a. LOWEST: The City will award the Project to the responsive and responsible bidder whose <br /> Bid is the lowest. In accordance with RCW 39.04.380,if a bid is received from a <br /> nonresident contractor from a state that provides an in-state percentage bidding preference <br /> and does not have an office located in Washington,then a comparable percentage <br /> disadvantage will be applied to the bid of that nonresident contractor. <br /> b. RESPONSIVENESS: City will consider all the material submitted by the bidder to <br /> determine whether it is in compliance with the Contract Documents. The City <br /> reserves the right, at its discretion, to reject nonresponsive Bids. <br /> c. RESPONSIBILITY: <br /> (1) Mandatory Responsibility Criteria: RCW 39.04.350(1). It is the intent of City to <br /> award a contract to the lowest responsive and responsible Bidder. Before award, <br /> the Bidder must meet the Bidder responsibility criteria under this Section <br /> 1.13.A.1.c.(1) to be considered a responsible Bidder. The Bidder may be required <br /> by the City to submit documentation demonstrating compliance with the criteria <br /> under this Section 1.13.A.1.c.(1). The Bidder must: <br /> (a) Registration. Have a current certificate of registration as a contractor in <br /> compliance with chapter 18.27 RCW, which must have been in effect at <br /> the time of bid submittal; and <br /> Kasch Park Soccer Fields-Synthetic Turf Replacement Phase 2 4 of 9 <br />
