Findings &Conclusions <br /> 2/25/04 <br /> Page 4 of 5 <br /> Summary of Issues Identified by Ecology as Relevant to Its Decision: No additional <br /> substantive issues were identified by Ecology. Changes that are being recommended by Ecology <br /> are for clarification and other minor purposes. See Attachment C for those changes and the <br /> reasons for the changes. <br /> CONCLUSIONS OF LAW <br /> The record submitted indicates that the City has complied with the requirements of RCW <br /> 90.58.100 regarding the SMP amendment process and contents. <br /> The record submitted indicates that the City has complied with the requirements of RCW <br /> 90.58.130 and WAC 173-26-090 regarding public and agency involvement to the SMP <br /> amendment process. <br /> The record submitted indicates that the City has combed with the,purpose and intentf of the local <br /> amendment process requirements contained i <br /> n WAC 17 ;2600�including conducting open <br /> houses and public hearings, notice, consultation with parties of"interest and solicitation of <br /> comments from tribes, government agencies and Ecology ` <br /> { <br /> The record submitted indicates that the City has complied with requirements of Chapter 43.21C <br /> RCW, the State Environmental Policy Act. <br /> The City SMP amendment submittal to Ecology wascomplete pursuant to the requirements of <br /> WAC 173-26-110. <br /> Although not all time frames were rtet, Neology has complied with the procedural requirements <br /> for state review and approval'of shoreline-mastersrogram amendments as set forth in WAC 173- <br /> 26-120. <br /> Ecologys concludedtthat, as submitted by the City, the proposed amendment requires <br /> lan tt e chap es in order e be inter ral l consistent. Based on the provisions of RCW <br /> gJHg, g t Y <br /> 90.58 090.:Ecology is required to recommend specific changes necessary to make the proposal <br /> approvable Therefore, if the ollowing (Attachment C) changes are accepted by the City, the <br /> proposal willAe consistent with RCW 90.58 and applicable rules. <br /> DECISION AND EFFECTIVE DATE <br /> Based on the preceding, Ecology has determined the proposed amendments, once required <br /> changes set forth herein are approved by the City, are consistent with the policy of the Shoreline <br /> Management Act and implementing rules. Ecology approval of the proposed amendments with <br /> required changes is effective on the date at which Ecology receives written notice that the City <br /> has agreed to the required changes. <br />
