ORDINANCE NO. 2769-04 <br /> AN ORDINANCE providing for the adoption of the 2003 <br /> Edition of the Uniform Plumbing Code and the <br /> Uniform Plumbing Code Standards and repealing <br /> Ordinance No. 2465-02 (Chapter 16.04 EMC) <br /> 2GNs <br /> WHEREAS, the City Council finds that this ordinance serves to protect the public <br /> health, safety and welfare; <br /> WHEREAS, the City Council finds that the absence of the regulations adopted by this <br /> ordinance would create public harm and a public nuisance; and <br /> WHEREAS, the City Council finds that the City is mandated by the State to implement <br /> and enforce the herein adopted code: <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: This ordinance shall be known as the "Everett Plumbing Code." <br /> Section 2: The Uniform Plumbing Code and the Uniform Plumbing Code Standards, <br /> together with Appendices A, B, D and H and the Installation Standards, as published by the <br /> International Association of Plumbing and Mechanical Officials, as amended by WAC 51-56 and <br /> 51-46, being particularly the 2003 Edition thereof and the whole thereof, save and except such <br /> portions as are hereinafter deleted, modified or amended are hereby adopted by reference and <br /> incorporated herein as fully as if set out at length herein, collectively herein referred to as the <br /> "Code" unless specifically provided otherwise. <br /> Section 3: Amendments made in the Uniform Plumbing Code and the Uniform Plumbing <br /> Code Standards. <br /> A. Section 101.2 of the 2003 Edition of the Uniform Plumbing code is hereby amended <br /> by addition of the following: <br /> It is expressly the purpose of this Code to provide for and promote the health, safety <br /> and welfare of the general public and not to create or otherwise establish or <br /> designate any particular class or group of persons who will or should be especially <br /> protected or benefited by the terms of this Code. <br /> It is the specific intent of these regulations to place the obligation of complying with <br /> these regulations upon the permit applicant and any person owning, operating or <br /> controlling any building or structure within its scope. No provision nor term used in <br /> the Code is intended to impose any duty whatsoever upon the City or any of its <br /> officers or employees, for whom the implementation or enforcement of this Code <br /> shall be discretionary and not mandatory. <br /> DEDI/ORDINANCE/UNIF PLUB CODE 2004 <br />
