Q. Section Rooftop Drainage. <br /> Section 903.4 of the 2003 Edition of the IRC and Section 1503.4 of the 2003 <br /> Edition of the IBC are hereby amended by adding the following: <br /> Rooftop drainage must be addressed and shall be disposed of by one of the <br /> following methods: <br /> a. tight line to storm drain system (private or public) <br /> b. concrete splash blocks <br /> c. tight line to roof runoff infiltration system <br /> A tight line to the property line with direct discharge to the abutting property <br /> or public right-of-way is prohibited unless specifically approved by the City <br /> on the construction plans/permit. <br /> In all cases, the method selected will be subject to approval by the City's <br /> Public Services Division, with considerations given to site, soil types, slope <br /> conditions, and the nature of the development. <br /> R. The 2003 Editions of the IBC and IRC are amended by addition of the following <br /> section: <br /> Authority to Abate <br /> 1. Any violation of the IBC or IRC is hereby declared to be a nuisance. <br /> 2. Where a nuisance exists, the City Attorney on behalf of the City is <br /> authorized to institute injunction, mandamus, or other appropriate action <br /> or proceeding to prevent the violation of the IBC or IRC. <br /> 3. Notwithstanding paragraph (2), the City Attorney is authorized to apply to <br /> any court of competent jurisdiction for and such court, upon hearing and <br /> for cause shown, may grant a temporary or permanent injunction <br /> restraining any person, firm and/or corporation from violating any <br /> provision of this Code and compelling compliance herewith. The cost of <br /> such action shall be taxed against the violator. <br /> 4. A conviction of any person, firm or corporation for violating this Code <br /> shall not impede the authority granted in this section to the City Attorney <br /> or City. <br /> Section 5: The City of Everett hereby declares that should any section, paragraph, <br /> sentence or word of this Ordinance or of the 2003 Editions of the IBC, IRC or International <br /> Performance Code hereby adopted be declared for any reason to be invalid, it is the intent <br /> of the City of Everett that it would have passed all portions independent of the elimination <br /> here from of any such portion as may be declared invalid. <br /> 5 <br /> DEDI/ORDINANCE/INTL BLDG CODE <br />
