.0G2 <br /> ORDINANCE NO. 2772-04 <br /> AN ORDINANCE providing for the adoption of the 2003 Edition of the International <br /> Mechanical Code and the International Fuel Gas Code and repealing Ordinance No. 2365- <br /> 99 (Chapter 16.02 EMC). <br /> WHEREAS, the City Council finds that this ordinance serves to protect the public <br /> health, safety and welfare; and <br /> WHEREAS, the City Council finds that the absence of the regulations adopted by <br /> this ordinance would create a public harm and a public nuisance; and <br /> WHEREAS, the City Council finds that the City is mandated by the State to <br /> implement and enforce the herein adopted code; <br /> NOW THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: This ordinance shall be known as the "Everett Mechanical Code." <br /> Section 2: The International Mechanical Code, together with Appendices A and C as <br /> published by the International Code Council, as amended by WAC 51-52 and the <br /> International Fuel Gas Code, except that the standards for liquefied petroleum gas <br /> installations shall be NFPA 58 (Storage and Handling of Liquefied Petroleum Gases) and <br /> ANSI 2223.1/NFPA 54 (National Fuel Gas Code, being particularly the 2003 Editions <br /> thereof and the whole thereof, save and except such portions as are hereinafter deleted, <br /> modified or amended are hereby adopted by reference and incorporated herein as fully as if <br /> set out at length herein. <br /> Section 3: Amendments made in the International Mechanical Code. <br /> A. Section 101.3 of the 2003 Edition of the International Mechanical Code is hereby <br /> amended by the addition of the following language. <br /> It is the specific intent of these regulations to place the obligation of complying with <br /> these regulations upon the permit applicant and any person owning, operating or <br /> controlling any building or structure within its scope. No provision nor term used in <br /> this Code is intended to impose any duty whatsoever upon the City or any of its <br /> officers or employees for whom the implementation or enforcement of this Code <br /> shall be discretionary and not mandatory. <br /> Nothing in this Code is intended to be nor shall be construed to create or form the <br /> basis for any liability on the part of the City or its officers, employees or agents, for <br /> any injury or damage resulting from the failure of a building to comply with the <br /> provisions of this Code, or by reason or in consequence of any inspection, notice, <br /> DEDI/ORDINANCE/INTNL.MECHANICAL CODE <br />
