.0G2 ORDINANCE NO. 2772-04 AN ORDINANCE providing for the adoption of the 2003 Edition of the International Mechanical Code and the International Fuel Gas Code and repealing Ordinance No. 2365- 99 (Chapter 16.02 EMC). WHEREAS, the City Council finds that this ordinance serves to protect the public health, safety and welfare; and WHEREAS, the City Council finds that the absence of the regulations adopted by this ordinance would create a public harm and a public nuisance; and WHEREAS, the City Council finds that the City is mandated by the State to implement and enforce the herein adopted code; NOW THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: This ordinance shall be known as the "Everett Mechanical Code." Section 2: The International Mechanical Code, together with Appendices A and C as published by the International Code Council, as amended by WAC 51-52 and the International Fuel Gas Code, except that the standards for liquefied petroleum gas installations shall be NFPA 58 (Storage and Handling of Liquefied Petroleum Gases) and ANSI 2223.1/NFPA 54 (National Fuel Gas Code, being particularly the 2003 Editions thereof and the whole thereof, save and except such portions as are hereinafter deleted, modified or amended are hereby adopted by reference and incorporated herein as fully as if set out at length herein. Section 3: Amendments made in the International Mechanical Code. A. Section 101.3 of the 2003 Edition of the International Mechanical Code is hereby amended by the addition of the following language. It is the specific intent of these regulations to place the obligation of complying with these regulations upon the permit applicant and any person owning, operating or controlling any building or structure within its scope. No provision nor term used in this Code is intended to impose any duty whatsoever upon the City or any of its officers or employees for whom the implementation or enforcement of this Code shall be discretionary and not mandatory. Nothing in this Code is intended to be nor shall be construed to create or form the basis for any liability on the part of the City or its officers, employees or agents, for any injury or damage resulting from the failure of a building to comply with the provisions of this Code, or by reason or in consequence of any inspection, notice, DEDI/ORDINANCE/INTNL.MECHANICAL CODE
