4 <br /> ?a y. <br /> ORDINANCE NO. 2776-04 <br /> AN ORDINANCE RELATING TO ADULT RETAIL BUSINESS USES, ADOPTING <br /> A MORATORIUM ON ESTABLISHING SUCH FACILITIES AND PROCESSING <br /> APPLICATIONS RELATED THERETO, AND DECLARING AN EMERGENCY. <br /> WHEREAS,the City Council does find: <br /> 1. The Council has enacted adult business regulations to ensure that such <br /> businesses are adequately regulated without impairing their <br /> constitutional rights to present protected expression; <br /> 2. The Council has adopted such regulations to govern a variety of aspects <br /> of the conduct of such businesses, including places within the City <br /> where they may locate, and the distances that such businesses should <br /> be set-back from sensitive uses, such as schools, parks, places of <br /> worship, residential zones, and day care centers; and <br /> 3. The Council is concerned about the proliferation within the City of <br /> adult retail business uses that deal primarily in the retail sale, rental or <br /> other transfer of adult-oriented books, videotapes and other adult <br /> paraphernalia, because such adult retail business uses are not currently <br /> regulated by existing regulations regarding location and set-backs from <br /> sensitive uses; and <br /> 4. These adult retail business uses have a potential for adverse social, <br /> economic and environmental impacts on the community, as determined <br /> by a variety of studies, court decisions and other records developed by <br /> other municipalities, and it is necessary to adopt a moratorium with <br /> respect to the siting of these facilities for the preservation of public <br /> health, safety and welfare, until the City can fully review such studies, <br /> court decisions and other records; and <br /> 5. RCW 35.63.200 and RCW 36.70A.390 and the City of Everett Charter, <br /> Article III, authorize the Council to enact moratoria on land use matters <br />
