ORDINANCE NO. 2787-04 <br /> AN ORDINANCE Relating to Animals, Amending Section 2 of Ordinance No. <br /> 1228-86, as amended by Section 1 of Ordinance No. 1257-86, as amended by <br /> Section 1 of Ordinance No. 2393-99 (EMC 6.08.010), Amending Sections 5, 6 <br /> and 9 of Ordinance No. 2393-99 (EMC 6.08.020, EMC 6.08.025 and EMC <br /> 6.08.045); and Amending Section 12 of Ordinance No. 1810-91, as amended by <br /> Section 9 of Ordinance No. 2394-99 (EMC 6.04.120). <br /> Whereas, the Legislature of the State of Washington has broadened the definition of <br /> what constitutes a dangerous dog, increased the amounts of bond or insurance for owners <br /> of dangerous dogs, set requirements for dangerous dog owners to pay the costs of <br /> confinement and control, and added affirmative defenses to dangerous dog crimes; and <br /> Whereas, the City of Everett City Council deems it appropriate for the City Criminal <br /> Code to be consistent with state law in this area; and <br /> Whereas, the City of Everett Animal Control division has provided the Everett City <br /> Council with information regarding the need for microchipping of potentially dangerous <br /> dogs as well as dangerous dogs; and <br /> Whereas, the City of Everett City Council has also been provided with information <br /> regarding the need to clarify current restraint requirements of potentially dangerous dogs; <br /> Whereas, the City Council of the City of Everett deems it appropriate to require <br /> microchipping of potentially dangerous dogs and clarify current restraint requirements of <br /> potentially dangerous dogs; and <br /> Whereas, it has come to the attention of the City of Everett that there may be <br /> longstanding existing Federally licensed facilities located within the City of Everett <br /> which may be in conflict with Section 12 of Ordinance 1810-91 as amended by Section 9 <br /> of Ordinance 2394-99 (EMC 6.04.120); and <br /> Whereas, it is the intent of the City of Everett to exclude from the provisions of EMC <br /> 6.04.120 any such existing businesses as of January 1, 2000 which are Federally licensed <br /> and operating in compliance with those licensing provision; <br /> Page 1 <br />
