i • I a7 Ordinance No. 2785-04 An Ordinance relating to taxicab number of allowable licenses, Amending Section 8 of Ordinance No. 2297-98 (EMC 5.68.070). Whereas,the City Council does find that the Council has enacted for-hire vehicle regulations to provide that such businesses are adequately regulated to protect the public health, safety and welfare and to promote safe, reliable and economically viable and stable taxicab transportation service; and Whereas,the City Council is concerned that an increase in licensed taxicabs in the City following a recent rate increase would impact this service to the community; and Whereas, on June 16, 2004 the City Council enacted an ordinance that increased the rates and established a 90-day period during which no new applications for taxicab licenses would be processed or issued to preserve the status quo to allow time to determine whether a cap should be placed on the number of taxicab licenses issued by the City and, if so, to research and evaluate the number of taxicab licenses that would best promote the goals herein stated; and Whereas, the City Council does conclude that a limitation on the number of allowable taxicab licenses will further the goals of for-hire vehicle regulations as herein stated and also allow for sufficient taxicab service to the public; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: Section 8 of Ordinance No. 2297-98 (EMC 5.68.070), which reads as follows: License term—Expiration of licenses and license fees—Limitation. A. All licenses issued under this chapter shall expire on July 31st of each year. Such licenses may be renewed by the license holder for the succeeding year by making application therefor with the city clerk at least ten days prior to the expiration date. B. The city clerk may by order limit the number of licenses issued under this chapter when the city clerk determines it is necessary in order to protect the general health, safety and welfare.
