t
/S/111611""voimia
Ordinance No. 2788-04
An Ordinance relating to Restrictions on Precursor Drugs,
Amending Section 1 of Ordinance No. 2541-01 (EMC 10.39.010) and Section 3 of
Ordinance No. 2541-01 (EMC 10.39.030).
Whereas the 2004 State Legislature has found that quantities of ephedrine,
pseudoephedrine, and phenylpropanolamine continue to be sold at the wholesale and
retail levels far in excess of legitimate consumer needs; and
Whereas the 2004 State Legislature has found that the excess quantities being sold are
most likely used in the criminal manufacture of methamphetamine, and that it is therefore
necessary to further regulate the sales of these drugs in order to reduce the threat that
methamphetamine presents to the people of the state; and
Whereas based on its findings the 2004 State Legislature revised state law so that it is
now unlawful for any person to sell or distribute ephedrine products unless the person is
licensed or registered by the Department of Health under the statute concerning
pharmacists or is a practitioner as defined in statute; and
Whereas the 2004 State Legislature also revised state law so that practitioners authorized
to prescribe drugs may sell, transfer or otherwise furnish ephedrine products only as long
as a single transaction does not exceed the three-package, three-gram limitation that
currently exists for other vendors; and
Whereas the Board of Pharmacy may exempt specific ephedrine products from the sales
restriction, upon application of the manufacturer, if the product meets the federal
definition of an ordinary over-the-counter pseudoephedrine product, or the net weight of
the pseudoephedrine base is equal to or less than three grams, even though the package's
total weight exceeds three grams, and the board determines that the value of the product
to the people of Washington outweighs the danger, and the product, as packaged, has not
been used in the illegal manufacture of methamphetamine; and
Whereas the State law amendments became effective July 1, 2004; and
Whereas the Everett City Council deems it appropriate for the City Criminal Code to be
consistent with state law in this area;
NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN:
Section 1: Section 1 of Ordinance No. 2541-01 (EMC 10.39.010), which reads as
follows:
