Section 9: All moneys derived from the sale of the above-described right-of-way vacation shall be deposited in the "Real Property Acquisition Fund." Section 10: This Ordinance shall not become effective until a SEPA Determination, including any appeal there from, for the Everett Clinic Expansion (which includes the proposed use of the area to be vacated) has become final and the owners of the property abutting upon the right of way herein described have compensated the City of Everett in an amount equal to the current appraised value of the area herein described after offset for the area which is being conveyed to the City to extend the alley in Block 4, Climax Land Company's 1st Addition. The abutting property owners shall have ninety (90) days following the date the SEPA Determination, including any appeal there from, for the Clinic Expansion becomes final to exercise this vacation. Unless otherwise amended by CityCouncil, this Ordinance shall become null and void if the abutting property owner(s) fail to exercise this vacation within ninety (90) days following the date the SEPA determination, including any appeal there from, becomes final. Section 11: Upon payment of the required compensation and fulfillment of the conditions set forth in Section 10, this ordinance shall be recorded with the Snohomish County Auditor's Office.
