Section 9: All moneys derived from the sale of the above-described right-of-way <br /> vacation shall be deposited in the "Real Property Acquisition Fund." <br /> Section 10: <br /> This Ordinance shall not become effective until a SEPA Determination, including any <br /> appeal there from, for the Everett Clinic Expansion (which includes the proposed use of <br /> the area to be vacated) has become final and the owners of the property abutting upon <br /> the right of way herein described have compensated the City of Everett in an amount <br /> equal to the current appraised value of the area herein described after offset for the <br /> area which is being conveyed to the City to extend the alley in Block 4, Climax Land <br /> Company's 1st Addition. The abutting property owners shall have ninety (90) days <br /> following the date the SEPA Determination, including any appeal there from, for the <br /> Clinic Expansion becomes final to exercise this vacation.
