2 <br /> FINDINGS OF FACT <br /> 1. Robert A. Schleiffers, Respondent, is the owner of record of property at 2620 Rucker <br /> Avenue, Everett, Washington (property). The property is in an R-5 Core Residential <br /> zone as established by the City of Everett. (Exhibit#8, Snohomish County <br /> Assessors Record dated March 13, 2013) (Exhibit#9, Go Sync Map) <br /> 2. On December 11, 2011, the residential structure on the property was damaged by a <br /> fire. Because of the fire the structure was boarded and secured at that time and was <br /> posted condemned by the City of Everett Code Enforcement (ECE) unit. (Testimony <br /> of Code Enforcement Officer Wathen) <br /> 3. Complaints received that people were seen going inside the fire damaged structure <br /> and on November 30, 2012, ECE Officer Spring Wathen conducted an inspection of <br /> the property. ECE Officer Wathen observed that the front door and the south side <br /> door of the structure were unlocked and could be easily opened. (Testimony of Code <br /> Enforcement Officer Wathen) <br /> 4. On December 4, 2012, ECE Officer Wathen contacted Celeste Schleiffers, wife of <br /> the Respondent. Mrs. Schleiffers explained that they were in negotiations with Wells <br /> Fargo Bank and an insurance company regarding the property damage and loss. <br /> Mrs. Schleiffers agreed to have the structure secured. On January 3, 2013, ECE Officer Wathen inspected the property and observed and <br /> photographed that the structure had not been secured. She also observed <br /> mattresses, tires and miscellaneous trash and debris had been discarded on the <br /> property. On January 8, 2013, ECE Officer Wathen contacted the Respondent stating that the <br /> structure on the property remained open to unauthorized entry and was required to <br /> be secured. She advised the Respondent that the items discarded on the property <br /> had to be removed and that the property must be maintained. (Testimony of Code <br /> Enforcement Officer Wathen) <br /> 7. On January 15, 2013, ECE Officer Wathen reinspected the property and observed <br /> and photographed that although the front door had been boarded and secured, the <br /> south side door remained unlocked thereby allowing access into the structure. On January 30, 2013, ECE Officer Wathen reinspected the property and observed <br /> and photographed that the conditions remained the same as seen on January 15, <br /> 2013.
